<br />28. <br /> <br />INTERLOCAL AGREEMENT <br />BETWEEN HAYS COUNTY <br />AND THE CITY OF SAN MARCOS <br /> <br />rOR1GÎNAt) <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />The City of San Marcos ("City") and Hays County (the "County"), enter into this Interlocal <br />Agreement under the authority of the Interlocal Cooperation Act, Chapter 791 of the Texas <br />Government Code, as amended. Both parties wish to participate in the National Resource <br />Conservation Service ("NRCS")/Office of Rural Community Affairs ("ORCA") funded project <br />to clear, and dispose of trees, logs, brush, shrubs, stumps and rubbish from designated areas <br />along the Blanco Riv~r (the "Project") as per the specifications provided by the NRCS under the <br />Watershed Protection Act. Both parties understand that NRCS is the entity responsible for the <br />provision of specifications, the bidding process and awarding the contract for the Project. Both <br />parties agree as follows: <br /> <br />Section 1. Scope of Services <br /> <br />A. City Aereements: <br /> <br />1) To provide up to $92,000.00 in matching funds from the City's Housing and <br />Urban Development ("HUD") Community Development Block Grant ("CDBG") <br />funds for the portion of the Project within the City limits. The City will make <br />payment to NRCS County in accordance with pay estimates submitted by NRCS <br />based on the percentage of work completed at the time of submission. <br />2) To name Ken Bell, City Fire Marshal, as the City's Project Manager. <br />3) To secure permission and/or waivers for pit burning within the City limits. <br />4) To fully cooperate with the County Grants Office as necessary. <br /> <br />B. County Aereements: <br /> <br />1) To provide up to $217,790.00 in matching funds from the State of Texas ORCA <br />Emergency Program for this Project. <br />2) To name Mark Chambers, Hays County Fire Marshal, æ the County's Project <br />Manager. <br />3) To hire a Project superintendent to supervise the day-to-day Project operations <br />and who will report daily to the County on the progress of the Project. <br />4) To fully cooperate with the City's Community Development Program Manager as <br />necessary. <br /> <br />Section 2. Term . <br />The term of this Agreement will commence on ~~ ':2.. , 2004 and will continue <br />until the Project is completed to the satisfaction of both parties unless terminated in accordance <br />with Section 3.G. <br />
