<br /> <br />c;- <br /> <br />RESOLUTION <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS <br />AUTHORIZING THE CITY MANAGER TO BRING SUIT AGAINST THE OWNER <br />OF LANJJ HEREIN DESCRIBED TO ACQUIRE RIGHT-OF-WAY EASEMENT TO ANIl <br />FROM A SEWAGE DISPOSAL LIFT STATION. <br /> <br />I <br /> <br />WHEREAS, the City Council of the City of San Marcos has found <br /> <br />and determined that public necessity requires the construction of a <br /> <br />sewage disposal line within and adjacent to the City of San Marcos, <br /> <br />and particularly in the vicinity of Columbia Street, to provide for <br /> <br />the disposal of sewage accumulating on properties in and around the <br />City of San Marcos; and, <br /> <br />'JHEREAS, the City Council has found and determined that <br /> <br />public necessity requires the acquisition of a perpetual easement <br /> <br /> <br />thirty (30) feet in width across the hereinafter described tract of <br /> <br />land for a right-of-way to provide ingress and egress to and from <br /> <br />a sewage disposal lift station, said station to be constructed upon <br /> <br />land other than the hereinafter described tract; and <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos has negotiated with the <br /> <br />owner of the hereinafter described tract of land and has been unable <br /> <br />to agree with such owner as to the fair cash market value of such <br /> <br />easement; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS; <br /> <br />That the City Manager of the City of San Marcos be and he <br /> <br />is hereby authorized and directed to file or cause to be filed against <br /> <br />the owner, a suit in eminent domain to acquire a perpetual right-of- <br /> <br />way easement, hereinafter described by metes and bounds, to provide <br /> <br />ingress and egress to and from said sewage disposal lift station: <br /> <br /> <br />A strip of land thirty (30.00) feet in width, same being <br /> <br />I <br /> <br />out of and a part of the T. J. Chambers League in Hays County, Texas, <br /> <br />as well as being a part of that 11.16 acre tract of land conveyed to <br /> <br />Bertie Williamson and Thomas J. Williamson by deed from Henry A. <br /> <br />Leinneweber, et al., dated April 29, 1929, and recorded inVolume 98, <br /> <br /> <br />Page 301, Hays County Deed Records, the centerline of said thirty <br /> <br />foot perpetual easement being described by metes and bounds as <br /> <br />follows: <br /> <br />BEGINNING at a point located in the Southwest fence line of <br />said 11. <br />
