6. Upon completion of Phase f, 'and final payment specified in Section 3, those documents shall be turned over to the CITY and become CITY property. During the progress of tl~e progra~n, the CITY shall }lave full access to t.'.l~q work in l~rogross. S~ch access shall be at tl~e CONSUI,TAbIT'S l)rinc'ipa] office ].n A~stJn, Texas, or CONSULTANT will. provJ(le CITY with one copy of work to remain property of CONSULTANT. The CONSULTANT will not discriminate against any employee or applicant for employment because of race, color, religion, sex or national origin. The CONSULTANT shall take affir- mative action to ensure that applicants are employed and that employees are treated during employment, without regard to their race, color, religion, sex or national origin. Such action shall include, but not be limited to the .following: Employment, upgrading, demotions or transfers, recruitment or recruitment advertising; layoffs or termination; rates of pay or other forms of compensation; selection for training including at>prenticeship; and participation ~n recreational and educational activities. The CONSULTANT agrees to post in conspicuous places, available to employees and applicants for employme~lt, notices to be provided by the Government setting forth the provisions of this nondiscrimination clause. The CONSULTANT will in all soliciations or advertJ, sements for employees placed by or on behalf of the CONSULTANT, state that all qualified applicants will receive consideration for employment without regard to race, color, religion, sex, or national origin. The CONSULTANT will cause the foregoing provisions to be inserted in all subcontracts for any work covered by this contract so that such provisions will be binding on each subcontractor; provided that the foregoing provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials. The CONSULTANT shall keep such records and submit such reports concerning the racial and ethnic origin of applications for employment and employees as the CITY may require.
