PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br />This Agreement is made this the 15th day of July, 2008, between the City of San Marcos, <br />Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Kellogg Brown & Root <br />Services, Inc., a Delaware Corporation ("Engineer") for the provision of professional <br />engineering services in connection with the N. L.B.J. Drive Reconstruction Project (the <br />"Project"). <br />The City and the Engineer agree as follows: <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 Engineer will be responsible for the proper, accurate and adequate design and preparation <br />of plans and specifications and other construction contract documents and for construction <br />administration for the Project. The Project consists of improvements to LBJ Drive from Sessom <br />Drive to Holland Street. LBJ Drive currently is a heavily traveled minor arterial serving as a <br />major north/south thoroughfare that is one of the major access points to Texas State University - <br />San Marcos ("TxState") campus. It is currently a 2-lane roadway in various states, including <br />curb & gutter on the south end, to open ditch section on the north end, with no shoulders and <br />limited sidewalks. The proposed improvements consist of full reconstruction of approximately <br />3,200 linear feet of LBJ Drive, with intersection, signal, bicycle and pedestrian improvements. <br />The work will also include replacing existing 2-inch and 6-inch water lines with a 12-inch water <br />line. <br />1.0.2 The Engineer understands that funding for this Project is being provided by two sources: <br />a) The Project is considered a Surface Transportation Program -Metro Mobility ("STP- <br />MM") Project, partly funded by the Federal Highway Administration ("FHWA") <br />through a grant administered by the Texas Department of Transportation ("TxDOT") <br />under the terms of a Local Transportation Project Advanced Funding Agreement and <br />all design work and construction documents will meet American Association of State <br />Highway Officials ("AASHTO") standards at a minimum, but will attempt to meet <br />TxDOT standards as indicated in this Agreement. <br />b) The waterline replacement will be financed by Revenue Bonds issued by the City and <br />all design work related to these improvements will meet City of San Marcos and City <br />of Austin standards and specifications. <br />1.0.3 The Engineer's Basic Services consist of the services described in Sections 1.0 through <br />1.5 and include normal civil engineering services as well as those engineering services to be <br />performed through the following consulting disciplines as subcontractors to the Engineer: <br />
