Exhibit "D" <br />Special Conditions <br />The Lessor and Lessee have entered into a Lease (the "Lease ") for the use of certain premises more <br />fully described therein (the "Leased Premises "). In addition to the provisions stated in the Lease, the <br />parties wish to further set forth additional terms and provisions of the Lease. <br />This Exhibit is attached to the Lease and made a part thereof for all purposes. Except as <br />otherwise provided herein, all defined terms in the Lease shall have the same meaning in this Exhibit; <br />however, in the event of any conflict between the provisions of the Lease and the provisions of this <br />Exhibit, the provisions stated herein shall control. <br />Notwithstanding any other provision of the Lease, the Lessor and Lessee agree to the <br />following: <br />1.) Lessee is responsible for the maintenance and repair of all light fixtures, including lamps, bulbs, <br />and ballasts, located inside the Leased Premises. <br />2.) Lessee is responsible for the inspection, maintenance, and repair of all fire safety equipment, <br />including fire extinguishers and exit lights, located within the Leased Premises <br />3.) Condition. Except as otherwise stated herein and in this Lease, Lessee accepts the leased <br />premises in its present condition. However, Lessor, at Lessor's expense, shall 1) combine the former <br />examination rooms 2 and 3 into one larger clinic room with an L- shaped counter and sink; 2) combine <br />former examination room 5 and reception room 6 into one reception area; 3) renovate restroom 4 to be <br />ADA compliant; 4) remove the sink in examination room 1; and 5) repair damage due to building <br />movement and moisture /rot. <br />4.) Sign. Lessee may change the sign in front of the Leased Premises to read "WIC ". Lessee is <br />responsible for any required City of Lockhart sign permits or fees. <br />5) Plugged drains and toilets. Lessee is responsible for the cost of repairing (whether by snaking or <br />by chemical means) any plugged, backed -up, or slowly draining drains or toilets located within the <br />Leased Premises. <br />6) Base Rent. Base Rent as set forth in Paragraph 2.1 shall be $900.00 per month for the first 24 <br />months of the Lease's term; $950.00 per month for the second 24 months of the Lease's term; and <br />$975.00 per month for the remainder of the Lease's term. <br />7) Satellite. Lessee shall be permitted to install a Very Small Aperture Terminal (VSAT) on the <br />Building as required by the State of Texas for satellite transfer data related to Lessee's activities. <br />Lesso <br />19 Lessee: <br />W.I.C.
