I Department shall pay the Contractor pursuant to the provisions of Section 5, provided that all other conditions and obligations of performance pursuant to Section 3 have been fully and satisfactorily met by the Contractor. C. Notwithstanding any other provision of this contract, it is expressly understood and agreed to by the parties to this contract that 'all liabilities and obligations of the Department hereunde' are contingent upon the final completion of the Mental Health/Mental Retardation Center and operational plan which are the objects of this contract. In the event that Contractor fails to complete this facility and operational plan in accordance with Section 3 of this contract, Contractor shall promptly return to Department the amount, if any, the Department has paid to Contractor hereunder. .Section 3. The parties hereto agree to amend Section 3 of such contract identified in Section 1 of this amendment No.1. This provision shall now be modified to read as follows: I I A. Contractor's performance shall be accomplished in three parts. ?art_lshall include Contractor providing for the administrationl of the construction phase of the project for a Mental Health/Mental Retardation Center for the City of San Marcos and shall include Contractl providing architectural and engineering services and contract adminis- tration and supervision of the actual construction to assure compliance with construction contract terms, and provide resident inspection, as tieeded, for th~ construction of this center being constructed under contract with the Economic Development Administration. Such performance shall include but not be limtied to the following: :1.
