<br />I <br /> <br />I <br /> <br />I <br /> <br />40 <br /> <br />ORDINANCE NO. 1979-9 <br /> <br />AN ORDINANCE EXTENDING THE TIME WITHIN <br />WHICH THE TEXAS MUSEUM OF HISTORY, INC. <br />WILL RETAIN THE POWERS GRANTED BY ORDINANCE <br />NO. 1974-48, APPROVED ON SEPTEMBER 9, 1974, <br />AND OF RECORD IN VOLUME 44, PAGE 47, OF THE <br />MINUTES OF THE CITY COUNCIL, AND LATER <br />AMENDED BY ORDINANCE 1977-46, APPROVED <br />NOVEMBER 7. 1977, AND OF RECORD IN VOLUME <br />47, PAGE 168, OF THE MINUTES OF THE CITY <br />COUNCIL WHICH DEDICATED A CERTAIN TRACT <br />OF REALTY FOR THE PURPOSE OF A PUBLIC <br />MUSEUM, SAID TRACT TO BE USED FOR A MUSEUM, <br />SAID MUSEUM TO BE CONSTRUCTED UNDER THE <br />MANAGEMENT OF THE TEXAS MUSEUM OF HISTORY, <br />INC.; EXTENDING THE TIME WITHIN WHICH THE <br />BUILDING MUST BE COMPLETED; AUTHORIZING <br />THE CITY MANAGER OF SAN MARCOS TO ENTER <br />INTO CONTRACTUAL AGREEMENTS WITH TEXAS <br />MUSEUM OF HISTORY, INC., AND TO TAKE ALL <br />STEPS NECESSARY TO EFFECTUATE THE INTENTS <br />AND PURPOSES EXPRESSED HEREIN. <br /> <br />WHEREAS, the City Council of the City of San Marcos approved <br />Ordinance 1974-48 on September 9, 1974; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos amended <br />that Ordinance by approving Ordinance 1977-46 on November 7, 1977; <br />and, <br /> <br />WHEREAS, the City Council of the City of , San Marcos wishes to <br />extend the time limits set by that Ordinance while continuini 'ihe <br />the provisions of that ordinance; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the certain tract of real property described <br />in Section 1 of Ordinance 1977-46, of Record in Volume 47, Page 168 <br />of the Minutes of the City Council of San Marcos, Texas, be and is <br />hereby, designated for the site and location of a public museum. <br /> <br />SECTION 2. That the City Council hereby expresses its desire <br />to enter into contractual agreements with Texas Museum of History, <br />Inc., for the placement of a museum building on said site. <br /> <br />SECTION 3. That Texas Museum of History, Inc., is hereby <br />given the power to control, manage, and generally supervise the <br />process of constructing and completing the building which is to <br />be used for the said museum purposes. <br /> <br />SECTION 4. That the City of San Marcos, Texas, shall have no <br />obligation whatsoever in funding or paying for any part of the cost <br />of such museum building. <br /> <br />SECTION 5. That Texas Museum of History, Inc., will retain <br />the aforesaid power for five (5) years from the effective date of <br />this ordinance; it being the will and intent of the City Council <br />that the aforesaid museum building be completed within five (5) <br />years from the effective date of this ordinance. <br /> <br />SECTION 6. That the City shall retain ownership of the <br />realty shall also own the museum building to be constructed on <br />the realty, and shall not permit any construction to commence <br />until the City enters into a satisfactory agreement with the <br />Texas Museum of History, Inc., for said construction and funding <br />of said building. <br />
