I I I 44 RESOLUTION NO. 1979-l7-R RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING ACCEPTANCE OF THE COMPLETION OF LIBRARY IMPROVEMENTS IN SAN MARCOS, TEXAS; AUTHORIZING FINAL PAYMENT FOR THIS CONSTRUCTION; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the City of San Marcos, Texas has contracted with Division II Constructors, Inc. for the construction of Library Improvements in San Marcos, Hays County, Texas; and WHEREAS, the construction of these improvements was completed on March 1, 1979; and WHEREAS, the City Engineer has inspected these improvements and determined that the contractual provisions for construction of said Library Improvements had been met by Division II Constructors, Inc. on that date; and WHEREAS, the Engineer for the City of San Marcos recommends that the City Council accept the Library Improvements for use by the City effective March 1, 1979 and authorize final payment to Division II Constructors, Inc. in the amount of $1,887.00; and WHEREAS, Division II Constructors, Inc. requests final payment for the completion of said Library Improvements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1: That the work performed by Division II Constructors, Inc. in constructing improvements for the San Marcos Public Library be and is hereby accepted as being complete effective on the lst day of March, 1979, pursuant to the terms of the contract for said construction. Section 2: That the City of San Marcos is hereby authorized to make the final payment to Division II Constructors, Inc. for said construction in the amount of $1,887.00. Section 3: That this Resolution shall take effect immediately from and after its passage. ADOPTED this 12th day of March, 1979. ~~~ Robert L.
