<br />Section 2 1/2-4. E. 1. The place of business is <br />not located within three hundred (300) feet of a <br />residence located within a "R-l" single-family <br />dwelling district or a "R-2" duplex or two-family <br />dwelling district. The measurements shall be <br />along the property lines of street fronts and <br />from front door to front door and in a direct <br />line across the street intersection where they <br />occur. <br /> <br />PART 3. That Section 2 1/2-4. E. 3 of Ordinance 1978-51 I <br />amending Chapter 2 1/2 of the Code of Ordinances of the City <br />of San Marcos, entitled "Alcoholic Beverages", be, and is <br />hereby, repealed. <br /> <br />PART 4. That Section 2 1/2-4. E. 6 (I) of Ordinance 1978-51 <br />amending Chapter 2 1/2 of the Code of Ordinances of the City <br />of San Marcos, entitled "Alcoholic Beverages" be, and is hereby, <br />amended to change the dimension requirements for each parking <br />space required and to ensure that parking requirements provide <br />for premises which include outdoor serving areas, to-wit: <br /> <br />Section 2 1/2-4. E. 6. Hard surfaced off- <br />street parking shall be provided on the <br />premises for which the Conditional Use <br />Permit is applicable according to the <br />standard of one (I) parking space consisting <br />of the dimension of eight (8') feet by twenty <br />(20') feet, one hundred and sixty-two (162) <br />square feet, for each one hundred (100) square <br />feet of total area. For purposes of meeting <br />the requirements of this section, total area <br />of the place of business shall be the building <br />floor area and/or any outside serving area. <br /> <br />PART 5. That Section 2 1/2-4. F of ordinance 1978-51 <br />amending Chapter 2 1/2 of the Code of Ordinances of the City <br />of San Marcos, entitled "Alcoholic Beverages" be, and is <br />hereby, amended to change the person to whom a Conditional <br />Use Permit is issued, to-wit: <br /> <br />I <br /> <br />Section 2 1/2-4. F. A Conditional Use Permit <br />shall be issued only to and for the benefit of <br />the holder of an Alcoholic Beverage Permit <br />issued by the State of Texas for the place of <br />business and premises for which the Conditional <br />Use Permit is requested. <br /> <br />PART 6. That Section 2 1/2-4. G of Ordinance 1978-51 <br />amending Chapter 2 1/2 of the Code of Ordinances of the City <br />of San Marcos, entitled "Alcoholic Beverages" be, and is <br />hereby, repealed. <br /> <br />PART 7. That Section 2 1/2-4. K of Ordinance 1978-51, <br />amending Chapter 2 1/2 of the Code of Ordinances of the City <br />of San Marcos, entitled "Alcoholic Beverages", be, and is <br />hereby, amended by changing the person to whom notice is <br />given when there are alleged violations of conditions or <br />abuse of Conditional Use Permit privileges, to-wit: <br /> <br />Section 2 1/2-4. K. Upon excessive violation <br />of conditions or abuse of Conditional Use <br />Permit privileges, the City of San Marcos shall <br />have the right to revoke any Conditional Use <br />Permit as to any permit holder upon ten (10) <br />days written notice to said permit holder and <br />upon Revocation Hearing before the Zoning <br />Board of Adjustment. <br /> <br />I <br />
