<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION NO. 1979-18-R <br /> <br />58 <br /> <br />,,:.1 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, APPROVING A <br />CONSTRUCTION AGREEMENT WITH MISSOURI- <br />KANSAS-TEXAS RAILROAD COMPANY FOR <br />INSTALLATION OF A WATER LINE UNDER <br />RAILROAD TRACKS TO CONNECT WITH A WATER <br />LINE IN REDWOOD ROAD; AUTHORIZING THE <br />MAYOR TO EXECUTE SAID AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas, wishes to construct <br />a water line along Redwood Road in said City and in order to do <br />so, needs to run a water line beneath the Missouri-Kansas-Texas <br />Railroad tracks; and, <br /> <br />WHEREAS, the Missouri-Kansas-Texas Railroad Company required <br />a construction agreement be entered into, along with the payment <br />of $275.00 Pipe Line License fee; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART I. That the construction agreement in the form of a <br />Pipe Line Crossing License with the ~Iissouri-Kansas-Texas Railroad <br />Company for construction of a water line beneath the Missouri- <br />Kansas-Texas Railroad tracks, be, and is hereby, in all things <br />approved. <br /> <br />PART 2. That the Mayor, Robert L. Cavazos, or his successor, <br />be, and is hereby, authorized to execute said agreement on behalf <br />of the City. <br /> <br />PART 3. That the $275.00 Pipe Line License Fee has been <br />approved in the Community Development Program Year IV budget for <br />construction of a water storage facility. <br /> <br />PART 4.
