<br />I <br /> <br />I <br /> <br />I <br /> <br />III <br /> <br />RESOLUTION NO. 1979-38-R <br /> <br />A RESOWTION OF THE CITY COUNCIL OF THE CITY OF SAN MAICOS, <br />TEXAS, PROTESTIN; THE ABOLITION OF CITY AUTHORITY 0\1ER <br />ELEX::.rRIC urILITY RATES. <br /> <br />WHERE'AS, the Texas House of Representatives has passed Bill 41585 which <br />gives the Public Utility Ccmnission original and exclusive jurisdiction over <br />all rates, operations and services of electric utilities for the purpose of <br />regulating those rates, operations and services; and, <br /> <br />WHEREAS, said Bill 41585 and its counterpart, Senate Bill 312, abolish <br />local regulation of electric utilities, a responsibility which has been <br />assumed and exercised with vigor and diligence by this Council with the <br />support of, and to the great benefit of the citizens of San Marcos; and, <br /> <br />WHERE'AS, this Council does not wish to abdicate or delegate this <br />responsibility to a State Carmission canposed of officers and anployees <br />unfamiliar and possibly unresponsive to the needs and conditions existing <br />at the local level; and, <br /> <br />WHEREAS, this Council further objects to the burden imposed on local <br />governmental officials who would be canpelled to travel great distances <br />to protect the interests of their constituents; and, <br /> <br />WHEREAS, these bills place an even greater burden on the private <br />citizens who feel the need to exercise their rights in the regulatory <br />pr=ess but who quite probably would have neither the time nor the <br />financial resources to travel to appear before a State Carmission; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUN2IL OF THE CITY OF SAN MAICOS, TEXAS: <br /> <br />PARI' 1. That this Council protests the abolition of local control and <br />regulation of public utility ccrnpanies since local governmental units have <br />exercised their powers of regulation, arxl intend to continue to protect <br />the welfare of their citizens. <br /> <br />PARI' 2. That the Texas State Senators be, and are hereby, strongly <br />encouraged to defeat the passage of Senate Bill 41312 which abolishes City <br />authority over electric utilities. <br /> <br />PARI' 3.
