<br />RESOLUTION NO. 1979-47-R <br /> <br />163 <br /> <br />I <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, DESIGNATING <br />CERTAIN CITY OFFICIALS AS BEING RESPON- <br />SIBLE FOR ACTING ON BEHALF OF SAID CITY <br />IN DEALING WITH THE TEXAS PARKS AND WILD- <br />LIFE DEPARTMENT FOR THE PURPOSE OF PARTI- <br />CIPATING IN THE LAND AND WATER CONSERVATION <br />FUND ACT OF 1965; AND CERTIFYING THAT THE <br />CITY OF SAN MARCOS, TEXAS, IS ELIGIBLE TO <br />RECEIVE ASSISTANCE UNDER SUCH PROGRAM. <br /> <br />WHEREAS, the United States Congress has passed the Land <br />and Water Conservation Fund Act of 1965 (Public Law 88-578), <br />authorizing the Secretary of the Interior to provide financial <br />assistance to states and political subdivis10ns thereof, for <br />outdoor recreation purposes; and, <br /> <br />WHEREAS, the Texas Legislature has adopted 1113.,309, TEX. <br />PARKS AND WILDLIFE CODE, for the purpose of allowing the State <br />of Texas and its political subdivisions to participate in the <br />Federal program established under said Public Law 88-578, or <br />such other programs as are hereafter estaolished by the <br />Federal Government; and, <br /> <br />WHEREAS, the City of San Marcos, Texas, is fully eligible <br />to receive assistance under this Program; and, <br /> <br />WHEREAS, the City Council of said City is desirous of <br />authorizing its administrative staff to represent and act for <br />the City in dealing with the Texas Parks and Wildlife Department <br />concerning this program; now, therefore, <br /> <br />I <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the City Council of the City of San Marcos, <br />Texas, hereby certifies that sufficient funds are available to <br />meet its share, if any, of the cost of projects developed <br />pursuant to this Program and that the developed areas will be <br />operated and maintained at its expense for pUblic outdoor <br />recreation use. <br /> <br />SECTION 2. That the City Council hereby authorizes and <br />directs its Mayor to represent and act for the City of San Marcos <br />in dealing with the Texas Parks and Wildlife Department for the <br />purpose of this Program. The Mayor is hereby officially designat <br />ed as the City's representative in this regard. <br /> <br />SECTION 3. The City Council hereby designates its Director <br />of Finance" Mr. Earl T. Williams, or his successor, as the <br />official authorized to serve as the CityCs fiscal officer to <br />receive Federal funds for purposes of this Program. <br /> <br />I <br /> <br />SECTION 4. That the City Council hereby specifically <br />authorizes the Mayor, John A. Hansen, or his successor, to make <br />application to the Texas Parks and wildlife Department concern~ <br />ing the tract of land located in Caldwell County on the former <br />site of Camp Gary for use as a park site, and that said site is <br />hereby dedicated for public outdoor recreation,purposes. <br /> <br />SECTION 5. That this Resolution shall be in full force and <br />effect immediately upon its passage. <br /> <br />ADOPTED this 25th day, )of June, 1979., <br />
