<br />I <br /> <br />I <br /> <br />I <br /> <br />181 <br /> <br />RESOLUTION NO. 1979-48-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, DECLARING <br />THAT CERTAIN STATE-OWNED SURPLUS PROPERTY <br />IS NOT NEEDED BY THE CITY OF SAN MARCOS <br />AND AGREEING TO ITS TRANSFER TO HAYS COUNTY. <br /> <br />WHEREAS, the City of San Marcos, Texas, has been notified <br />by District 14 of the State Department of Highways and Public <br />Transportation that there exists a 0.708 acre tract of land <br />on the Northwest side of Interstate Highway 35 approximately <br />0.45 miles Southwest of Loop 82 intersection in the City of <br />San Marcos and being abandoned right-of-way of Old U. S. <br />Highway 8l: and, <br /> <br />WHEREAS, it has been determined that said tract is surplus <br />to the needs for construction or roadside park purposes of <br />existing Interstate Highway 35; and, <br /> <br />WHEREAS, it is the State Department of Highways and <br />Public Transportation's policy to dispose of such surplus <br />right-of-way whenever possible; and, <br /> <br />WHEREAS, Hays County, who owns the land Northwest of and <br />immediately adjacent to this abandoned section for the operation <br />of Hays County Memorial Hospital, has expressed a desire to <br />acquire this surplus land: now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />Said 0.708 acre tract, more particularly described as <br />being a part of land acquired for right-of-way purposes from <br />H. D. Jones by deed dated October 20, 1936, as recorded in <br />Volume 112, Page 388, of the Hays County Deed Records, is no <br />longer needed and the City of San Marcos is agreeable to the <br />State Department of Highways and Public Transportation disposing <br />of this tract of surplus right-of-way to Hays County in <br />accordance with the policies and requirements of the State <br />Department of Highways and Public Transportation. <br /> <br />APPROVED AND ADOPTED this the 13th day of July, 1979. <br /> <br />~A~~~ <br /> <br />UJOhn M~YOr <br /> <br />ATTEST: / . <br /> <br />l?l/i~/ A, ~ <br />Ma.!iY. .
