<br />I <br /> <br />I <br /> <br />I <br /> <br />ORDINANCE NO. 1979-33 <br /> <br />192 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />CHAPTER 12, ENTITLED "GARBAGE AND TRASH" <br />OF THE CODE OF ORDINANCES OF SAID CITY, <br />BY INCREASING THE CHARGES GOVERNING THE <br />DISPOSING OF REFUSE AT THE CITY OF <br />SAN MARCOS SANITARY LANDFILL BY COMMERCIAL <br />REFUSE HAULERS FROM ONE DOLLAR ($1.00) PER <br />CUBIC YARIJDTO THREE DOLLARS ($3.00) PER <br />CUBIC YARD; BY ADDING A REQUIREMENT THAT <br />PERSONS OTHER THAN COMMERCIAL REFUSE HAULERS <br />PRESENT IDENTIFICATION SHOWING AN ADDRESS <br />WITHIN THE CORPORATE LIMITS OF SAID CITY <br />PRIOR TO USE OF SAID LANDFILL; AND DECLARING <br />AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 12-17 entitled "Disposal Charges, <br />sanitary landfill," of Chapter 12, entitled "Garbage and Trash" <br />be, and is hereby, amended to read as follows: <br /> <br />Sec. 12-17. Disposal charges, sanitary landfill. <br /> <br />The following charges shall govern the disposing <br />of refuse at the City of San Marcos sanitary <br />landfill: <br /> <br />1/2 ton truck <br />1 ton truck <br />1 1/2 ton truck <br />2 ton truck <br /> <br />$1. 00 <br />$3.00 <br />$5.00 <br />$7.00 <br /> <br />$2.00 <br />$4.00 <br />$3.00 per cubic yard <br />$9.00 <br /> <br />Two wheel trailers <br />Four wheel trailers <br />Commercial refuse haulers <br />Above 2 ton truck <br /> <br />For any vehicle smaller than 1/2 ton p~ckup there <br />will be a minimum charge of fifty cents ($0.50). <br /> <br />SECTION 2. That Chapter 12 entitled "Garbage and Trash" <br />of the Code of Ordinances of the City of San Marcos, Texas, <br />be, and is hereby, amended to add Section 12-17A which shall <br />read as follows: <br /> <br />Sec. 12-17 (A). Use of sanitary landfill restricted. <br /> <br />It shall be unlawful for any person except a <br />commercial refuse hauler having a valid permit <br />from the City of San Marcos to remove garbage <br />from premises other than owned by said hauler <br />to dispose of refuse at the City of San Ma~cos <br />sanitary landfill without first presenting a <br />valid voter registration certificate, driver's <br />license, or other similar identification which <br />belongs to said person and contains an address <br />within the corporate limits of the City of <br />San Marcos. <br /> <br />SECTION 3. That the importance of this ordinance creates <br />an emergency and an imperative public purpose necessary that <br />the provisions of the City Charter requiring that ordinances <br />shall be read on three several days be, and is hereby, dispensed <br />with. <br />
