I I I ORDINANCE NO. 1979-33 192 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 12, ENTITLED "GARBAGE AND TRASH" OF THE CODE OF ORDINANCES OF SAID CITY, BY INCREASING THE CHARGES GOVERNING THE DISPOSING OF REFUSE AT THE CITY OF SAN MARCOS SANITARY LANDFILL BY COMMERCIAL REFUSE HAULERS FROM ONE DOLLAR ($1.00) PER CUBIC YARIJDTO THREE DOLLARS ($3.00) PER CUBIC YARD; BY ADDING A REQUIREMENT THAT PERSONS OTHER THAN COMMERCIAL REFUSE HAULERS PRESENT IDENTIFICATION SHOWING AN ADDRESS WITHIN THE CORPORATE LIMITS OF SAID CITY PRIOR TO USE OF SAID LANDFILL; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 12-17 entitled "Disposal Charges, sanitary landfill," of Chapter 12, entitled "Garbage and Trash" be, and is hereby, amended to read as follows: Sec. 12-17. Disposal charges, sanitary landfill. The following charges shall govern the disposing of refuse at the City of San Marcos sanitary landfill: 1/2 ton truck 1 ton truck 1 1/2 ton truck 2 ton truck $1. 00 $3.00 $5.00 $7.00 $2.00 $4.00 $3.00 per cubic yard $9.00 Two wheel trailers Four wheel trailers Commercial refuse haulers Above 2 ton truck For any vehicle smaller than 1/2 ton p~ckup there will be a minimum charge of fifty cents ($0.50). SECTION 2. That Chapter 12 entitled "Garbage and Trash" of the Code of Ordinances of the City of San Marcos, Texas, be, and is hereby, amended to add Section 12-17A which shall read as follows: Sec. 12-17 (A). Use of sanitary landfill restricted. It shall be unlawful for any person except a commercial refuse hauler having a valid permit from the City of San Marcos to remove garbage from premises other than owned by said hauler to dispose of refuse at the City of San Ma~cos sanitary landfill without first presenting a valid voter registration certificate, driver's license, or other similar identification which belongs to said person and contains an address within the corporate limits of the City of San Marcos. SECTION 3. That the importance of this ordinance creates an emergency and an imperative public purpose necessary that the provisions of the City Charter requiring that ordinances shall be read on three several days be, and is hereby, dispensed with.
