<br />I <br /> <br />I <br /> <br />I <br /> <br />independent general construction contractor, proceed with <br />the acquisition and construction of the Project and perform <br />and supply, or cause to be performed and supplied, all <br />labor, materials, supplies, services and work necessary for <br />the acquisition and construction of the Project on the <br />Proj ect Site. As such independent general construction <br />contractor, the User represents, warrants and agrees as <br />follows: <br /> <br />(a) That it will be solely responsible for the design <br />and engineering of the Project and for ensuring <br />that the plans and specifications for the Project <br />are prepared in accordance with all applicable <br />laws, statutes, building codes and regulations; <br /> <br />(b) That it will hold a copy of the plans and speci- <br />fications for the Project, together with a copy <br />of any material additions, modifications or <br />revisions thereto, available at the offices of <br />the User for inspection by the Corporation upon <br />reasonable request; <br /> <br />(c) That it will be solely responsible for securing <br />and paying for all permits, fees and licenses <br />necessary for the acquisition and construction of <br />the Project, including permits and licenses for <br />crossing streets and pipelines, and for otherwise <br />determining that such acquisition and construc- <br />. tion are carried on in accordance with all appli- <br />cable laws, statutes, building codes and regula- <br />tions; <br /> <br />(d) That it will make, execute and deliver all con- <br />tracts, orders, receipts, writings and instruc- <br />tions with or to other persons, and in general do <br />or cause to be done all such other things, as may <br />be requisite for the proper acquisi tion and <br />construction of the Project; and <br /> <br />(e) That it will be solely responsible for all work <br />performed by any other contractors, subcontrac- <br />tors, vendors and materialmen with respect to the <br />Project and for making all payments due to such <br />contractors, subcontractors, vendors and <br />materialmen; provided that, to the extent <br />permitted by paragraph 3 hereof, the User shall <br />be entitled to reimbursement out of the proceeds <br />of the Bonds. <br /> <br />Further, the Corporation represents, warrants and agrees <br />that it will take no independent actions towards the <br />acquisition and construction of the Project without the <br />express approval of the User. <br /> <br />-4- <br />
