<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, APPROVING THE
<br />PRICE AND CONDITIONS OF THE SALE BY THE
<br />CITY OF SAN MARCOS, TEXAS, OF PART OF
<br />PARCEL NO. 10-1, DESCRIBED FURTHER ON
<br />EXHIBIT "A" ATTACHED HERETO, LOCATED WITHIN
<br />THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT
<br />PROGRAM AREA, TO JOHNNY L. FINCH AND JAMES
<br />DONNELLEY; AND AUTHORIZING THE MAYOR TO
<br />EXECUTE A WARRANTY DEED TO JOHNNY L. FINCH
<br />AND JAMES DONNELLEY.
<br />
<br />WHEREAS, the City of San Marcos, Texas, advertised for
<br />bids for the sale of that certain real property known as part
<br />of Parcel 10-1, and described more fully as 12,000 square feet
<br />in the Katy Addition on Exhibit "A" attached hereto, located
<br />within the Tex. A-6, Neighborhood Development Program area, in
<br />the San Marcos Record, a local newspaper with a general circu-
<br />lation w~thin the County of Hays, State of Texas; and,
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted
<br />by Johnny L. Finch and James Donnelley for said part of Parcel
<br />No. 10-1; and,
<br />
<br />WHEREAS, the said bid met the minimum disposition price
<br />set upon said property by the Board of Commissioners of the
<br />Urban Renewal Agency of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the said Board accepted the bid as the highest
<br />and best responsible bid for said property by a motion duly
<br />passed on July 10, 1979 after the bid opening of July 10, 1979;
<br />and,

<br />WHEREAS, said motion also approved the terms and conditions
<br />for the sale of the said property and recommended the approval
<br />of said purchase price and the approval of the terms and
<br />conditions for the sale, as contained in the bid documents, by
<br />the City Council of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth
<br />in said bid and the sales terms and conditions pertinent thereto
<br />conform to the Redevelopment Plan for the development of the City
<br />as a whole; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION I. That the terms and conditions of the sale by
<br />the City of San Marcos, Texas, of part of Parcel No. 10-1
<br />within the Tex. A-6, Neighborhood Development Program area,
<br />and more fully described as 12,000 square feet in the Katy
<br />Addition on Exhibit "A" attached hereto to Johnny L. Finch and
<br />James Donnel1ey, Trustees, are hereby approved.

<br />SECTION 2. That the consideration for the sale for said
<br />property being $11,400.00 for 12,000 square feet is hereby
<br />approved.
<br />
<br />SECTION 3. That the sale by the City of San Marcos is
<br />made subject to restrictions of the Redevelopment Plan for
<br />the Tex. A-6, Neighborhood Development Program, as approved
<br />and amended, said plan is on file and is available for
<br />inspection in the Office of the Director of Community Development
<br />of the City of San Marcos.

<br />SECTION 4. That the conditions of the disposition documents,
<br />including the Deed and Contract for Sale for Private Redevelopment,
<br />are on file and are available for inspection in the Office of the
<br />Director of Community Development of the City of San Marcos.
