I I I THE STATE OF TEXAS THE COUNTY OF HAYS I I I CONTRACT KNOW ALL MEN BY THESE PRESENTS: That on this 10th day of September, A.D., 1979, the City of San Marcos, Hays County, Texas, a municipal corporation existing by and under the laws of the State of Texas, hereinafter referred to as "City", and Heinroth & Morgan, Inc. hereinafter referred to as "Contractor" a firm doing business in San Marcos, Texas, entered into this agreement for construction of a T-Hanger structure and maintenance shop at San Marcos Municipal Airport located at Camp Gary, Caldwell County, Texas; the terms and consideration of said agreement being as follows: I. Contractor agrees to construct a single structure, nine (9) unit, prefabricated, all metal, painted aircraft "nested T-Hanger" in accordance with the particular specifications and plans attached hereto as Exhibit A, said specifications and plans being incor- porated herein for all intents and purposes as a part of this contract; said structure to be located by "Contractor" on the San Marcos Municipal Airport, at Camp Gary, Caldwell County, Texas. II. Contractor agrees to commence work under this contract on or before the 20th day of September, A.D., 1979, and to fully complete the project within 120 consecutive calendar days thereafter as stipulated in Exhibit A attached hereto; provided, however, that bad weather days, as determined by both parties, shall not be counted toward completion time of this contract. Contractor further agrees to pay as liquidated damages, the amount of $50.00 for each consecutive calendar day beyond the 120 day period allotted above for construction, that the project is not completed. Contractor agrees that timely completion of this project is of importance to the City and that City shall be entitled to withhold said liquidated damages from the final payment to the Contractor.
