Contractor agrees to provide all equipment necessary for the performance of this agreement and to maintain the Cemetery maintenance building at a state suitable with its use and compatible with the Cemetery property. Contractor agrees to provide said daily maintenance to coincide with the normal hours of operation of Ci ty Hall. VI. City agrees that Contractor is to furnish only normal and daily maintenance pursuant to this agreement and Contractor is not obligated hereby to provide extraordinary maintenance required by Acts of God. VII. City agrees to provide all water connections and water necessary for the performance of this contract by Contractor and to provide for all road maintenance at said Cemetery. Contractor agrees that any water connections standing above ground that are destroyed or damaged by the acts of Contractor or his employees shall be replaced by Contractor at Contractor's expense. City also agrees to provide electrical connections and pay an amount equal to the minimum charge for electricity supplied to said Cemetery. Contractor agrees to pay all charges for electricity above the minimum charge. VIII . Contractor agrees to provide City a Certificate of Insurance evidencing that Contractor is insured with general public liability insurance. Said policy of insurance shall provide for the following minimum coverage: $100,000.00 $300,000.00 $100,000.00 Personal injury per person Personal injury per occurrence Property damage IX. Should the terms and conditions of this contract be violated by either party or the purpose of the making of this contract be lost by either party, this conteact may be terminated by giving thirty (30) days written notice to the other party citing the reasons or violations necessitating termination. This contract shall cease and terminate on the lapse of thirty (30) days following receipt of such written notice. Any money due and payable by City to Contractor shall be paid prior to the lapse of such thirty (30) days and in the event that termination does not coincide with pay periods established herein, Contractor shall be entitled to a pro rata payment on a per diem basis. x.
