<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF
<br />THE CITY OF SAN MARCOS, TEXAS, APPROVING
<br />THE PRICE AND CONDITIONS OF THE SALE
<br />BY THE CITY OF SAN MARCOS, TEXAS, OF
<br />29,085 SQUARE FEET OUT OF THE KATY
<br />ADDITION; FURTHER DESCRIBED BY ~1ETES
<br />AND BOUNDS IN THE ATTACHED EXHIBIT
<br />A AND ALSO KNOWN AS A PART OF URBAN
<br />RENEWAL PARCEL NO. 10-1 LOCATED WITHIN
<br />THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT
<br />AREA, TO GRATZ-HENRY PROPERTIES, INC.;
<br />AUTHORIZING THE MAYOR TO EXECUTE A WARRANTY
<br />DEED TO GRATZ-HENRY PROPERTIES, INC.
<br />
<br />WHEREAS, the City of San Marcos, Texas, advertised for
<br />bids for the sale of that certain real property known as 29,085
<br />square feet out of the Katy Addition, also known as Urban Renewal
<br />Parcel No. 10-l, located within the Tex. A-6 Neighborhood
<br />Development Program area, in the San Marcos Daily Record, a
<br />local newspaper with a general circulation in the County of
<br />Hays, State of Texas; and,
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted
<br />by Gratz-Henry Properties, Inc. for said 29,085 square feet out
<br />of the Katy Addition; and,
<br />
<br />WHEREAS, the said bid met the mlnlmum disposition price
<br />set upon said property by the Board of Commissioners of the Urban
<br />Renewal Agency of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the said Board accepted the bid as the highest and
<br />best responsible bid for said property by a motion duly passed on
<br />September 11, 1979, after the bid opening of September 11, 1979; and,
<br />
<br />WHEREAS, said motion also approved the terms and conditions
<br />Dor the sale of the said property and recommended the approval of
<br />said purchase price and the approval of the terms and conditions
<br />for the sale, as contained in the bid documents, by the City Council
<br />of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth
<br />in said bid and the sales terms and conditions pertinent thereto
<br />conform to the Redevelopment Plan for the development of the City
<br />as a whole; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />SECTION 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, of 29,085 square feet out of the Katy
<br />Addition, also known as Urban Renewal Parcel No. 10-1, to Gratz-Henry
<br />Properties, Inc., are hereby approved.
<br />
<br />SECTION 2. That the consideration for the sale for said
<br />property being $20,359.50 for 29,085 square feet is hereby approved.
<br />
<br />SECTION 3. That the sale by the City of San Marcos is made
<br />subject to restrictions of the Redevelopment Plan for the Tex. A-6,
<br />Neighborhood Development Program, as approved and amended, said plan
<br />is on file and is available for inspection in the Office of the
<br />Director of Community Development of the City of San Marcos.
<br />
<br />SECTION 4. That the conditions of the disposition documents,
<br />including the Deed and Contract for Sale for Private Redevelopment,
<br />are on file and are available for inspection in the Office of tbe
<br />Director of Community nevelopment of the City of San Marcos.
