I lC Cf: - o:l tLl W I . 85 9 ORDINANCE NO. 1979-44 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO SAID CITY A CONTIGUOUS TRACT OF LAND CONTAINING 5.5 ACRES LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF SAID CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Robert F. Gaertner, the record owner of a tract of land containing 5.5 acres, which land is contiguous and adjacent to present boundaries and located within said City's extraterritorial jurisdiction, has duly petitioned by written petition the City of San Marcos to annex said tract to be hereafter incorporated for all purposes within the boundaries of said City; and, WHEREAS, said petition has been heard and considered by the City Council; and, WHEREAS, a copy of said petition is attached hereto and incorporated herein for all intents and purposes as Exhibit A; and, WHEREAS, a description of said tract by metes and bounds is attached hereto and incorporated herein for all intents and purposes as Exhibit B; and, WHEREAS, an opportunity has been provided after proper notice for all interested persons to be heard on the matter of said petition at a public hearing held on September 24, 1979, said date being not less than ten (10) days nor more than twenty (20) days prior to the first reading of this Ordinance; and, WHEREAS, said petition for annexation should be and is hereby granted; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the 5.5 acre tract, being a portion of the J. M. Veramendi League No.2 in Hays County, Texas and being a portion of that 9.331 acre tract conveyed by Leroy Wood and Evelyn Wood to Robert F. Gaertner by deed dated June 29, 1973 and recorded in Volume 259, page 843 of the Hays County Deed Records, said tract being more fully described by metes and bounds description in Exhibit B attached hereto and incorporated herein, be and is hereby annexed into the incorporated area of the City of San Marcos. PART 2. That the corporate limits of said City be and are hereby extended to include said newly annexed 5.5 acre tract. PART 3. That said 5.5 acre tract shall henceforth be a part of the City of San Marcos, and any inhabitants thereof shall be entitled to all the rights and privileges of all citizens, and shall be bound by the acts and ordinances, resolutions and regulations of the City. PART 4. That this Ordinance shall be in full force and effect ten (10) days from and after final passage and publication in a newspaper of general circulation in the area.
