<br />AN ORDINANCE OF THE CITY COUNCIL OF
<br />THE CITY OF SAN MARCOS, TEXAS, APPROVING
<br />THE PRICE AND CONDITIONS OF THE SALE
<br />BY THE CITY OF SAN MARCOS, TEXAS, OF
<br />A PORTION OF PARCEL NO. 10-1, DESCRIBED
<br />FURTHER ON EXHIBIT "A" ATTACHED HERETO,
<br />ALSO KNOWN AS URBAN RENEWAL PARCEL NO.
<br />lO-I, LOCATED WITHIN THE TEX. A-6,
<br />NEIGHBORHOOD DEVELOPMENT PROGRAM AREA,
<br />TO JOHNNY FINCH; AUTHORIZING THE MAYOR
<br />TO EXECUTE A WARRANTY DEED TO JOHNNY
<br />FINCH; AND DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, the City of San Marcos, Texas, advertised for bids
<br />for the sale of that certain real property known as a portion
<br />of Katy Addition, also known as Urban Renewal Parcel No. 10-l,
<br />located within the Tex. A-6, Neighborhood Development Program
<br />area, in the San Marcos Daily Record, a local newspaper with
<br />a general circulation in the County of Hays, State of Texas; and,
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted
<br />by Johnny Finch for said portion of Katy Addition; and,
<br />
<br />WHEREAS, the said bid met the minimum disposition price set
<br />upon said property by the Board of Commissioners of the Urban
<br />Renewal Agency of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the said Board accepted the bid as the highest and best
<br />responsible bid for said property by a motion duly passed on
<br />October 9, 1979, after the bid opening of October 9, 1979; and,
<br />
<br />WHEREAS, said motion also approved the terms and conditions for
<br />the sale of the said property and recommended the approval of said
<br />purchase price and the approval of the terms and conditions for
<br />the sale, as contained in the bid documents, by the City Council
<br />of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in
<br />said bid and the sales terms and conditions pertinent thereto
<br />conform to the Redevelopment plan for the development of the City
<br />as a whole; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Section 1. That the terms and conditions of the sale by the
<br />City of San Marcos, Texas, of a portion of land in the Katy
<br />Addition, also known as Urban Renewal Parcel No. lO-l, to Johnny
<br />Finch, are hereby approved.
<br />
<br />Section 2. That the consideration for the sale for said property
<br />being $720.00 for 800 square feet is hereby approved.
<br />
<br />Section 3. That the sale by the City of San Marcos is made subject
<br />to restrictions of the Redevelopment Plan for the Tex. A-6 Neighborhood
<br />Development Program, as approved and amended, said plan is on file
<br />and is available for inspection in the Office of the Director of
<br />Community Development of the City of San Marcos.

<br />section 4. That the conditions of the disposition documents,
<br />including the Deed and Contract for Sale for Private Redevelopment,
<br />are on file and are available for inspection in the Office of the
<br />Director of Community Development of the City of San Marcos. v~
<br />
<br />Section 5. That the purchaser is hereby placed on notice that the
<br />subject property is subject to assessment under the provisions of
<br />Article 1105b of the Revised Civil Statutes of the State of Texas.
