<br />ORDINANCE NO. 51
<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, APPROVING THE
<br />PRICE AND CONDITIONS OF THE SALE BY THE
<br />CITY OF SAN MARCOS, TEXAS, OF ONE-HALF
<br />OF PARCEL 12-2, DESCRIBED FURTHER BY METES
<br />AND BOUNDS ATTACHED HERETO, LOCATED WITHIN
<br />THE TEX. A-6, NEIGHBORHOOD DEVELOPMENT PROGRAM
<br />AREA, TO KOHUT & COLE; AUTHORIZING THE MAYOR
<br />TO EXECUTE A WARRANTY DEED TO KOHUT & COLE;
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City of San Marcos, Texas, advertised for bids
<br />for the sale of that certain real property known as a part
<br />of lot 1 and all of lots 2 and 3 of J.Q. Cliett First Addition
<br />and part of lot 1 and all of lots 2 and 3 of J. Q. Cliett Second
<br />Addition, also known as Urban Renewal Parcel No. 12-2, located
<br />within the Tex. A-6, Neighborhood Development Program area, in the
<br />San Marcos Record, a local newspaper with a general circulation
<br />in the County of Hays, State of Texas; and,
<br />
<br />WHEREAS, pursuant to said advertisement a bid was submitted by
<br />Kohut & Cole for said one-half of parcel 12-2; and,
<br />
<br />WHEREAS, the said bid met the minimum disposition price set
<br />upon said property by the Board of Commissioners of the Urban
<br />Renewal Agency of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the said Board accepted the bid as the highest and best
<br />responsible bid for said property by a motion duly passed on
<br />October 9, 1979, after the bid opening of October'19, 1979; and,
<br />
<br />WHEREAS, said motion also approved the terms and conditions for
<br />the sale of the said property and recommended the approval of said
<br />purchase price and the approval of the terms and conditions for
<br />the sale, as contained in the bid documents, by the City Council
<br />of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said
<br />bid and the sales terms and conditions pertinent thereto conform
<br />to the Redevelopment Plan for the development of the City as a
<br />whole; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />Section 1. That the terms and conditions of the sale by the City
<br />of San Marcos, Texas, of one-half of parcel 12-2, also known as Urban
<br />Renewal Parcel No. 12-2, to Kohut & Cole, are hereby approved.
<br />
<br />Section 2. That the consideration for the sale for said property
<br />being $3l.8l2~50 for 25,450 square feet is hereby approved.
<br />
<br />Section 3. That the sale by the City of San Marcos is made subject
<br />to restrictions of the Redevelopment Plan for the Tex. A-6, Neighbor-
<br />hood Development Program, as approved and amended, said plan is on
<br />file and is available for inspection in the Office of the Director
<br />of Community Development of the City of San Marcos.

<br />Section 4. That the conditions of the disposition documents, including
<br />the Deed and Contract for Sale for Private Redevelopment, are on
<br />file and are available for inspection in the Office of the Director
<br />of Community Development of the City of San Marcos.
<br />
<br />Section 5. That the purchaser is herby placed on notice that the
<br />subject property is subject to assessment under the provisions of
<br />Article 1105b of the Revised Civil Statutes of the State of Texas.
<br />
<br />Section 6. That the Mayor of the City of San Marcos, Texas, is
<br />hereby authorized to execute a warranty deed to Kohut & Cole from
<br />the City of San Marcos, for all that real property known as part
<br />of lot 1 and all of lots 2 and 3 of J. Q. Cliett First Addition
<br />and part of lot 1 and all of lots 2 and 3 of J. Q. Cliett Second
<br />Addition, also known as Urban Renewal Parcel No. 12-2, located
<br />within the Tex. A-6, Neighborhood Development Program.
