RESOLUTION NO. 1978-23-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ORDERING THAT A PROPOSITION FOR OR AGAINST THE REMOVAL OF THE RESTRICTION FOR PARKLAND USE ONLY FROM A 2-ACRE TRACT OF LAND LOCATED ALONG A PORTION OF BUGG LANE BE- TWEEN HOPKINS STREET AND MISSOURI-PACIFIC RAILROAD TRACKS BE PLACED ON THE APRIL 1, 1978 ELECTION BALLOT; AND DECLARING AN EFFECTIVE DATE. I WHEREAS, Southwest Texas State University is currently constructing a road across university property from Bugg to City Park which will serve as the only means of access for vehicular traffic to City Park; and, WHEREAS, officials of Southwest Texas State University have requested that the City convey a 2-acre tract of land located along a portion of Bugg Lane between Hopkins Street and the Missouri-Pacific Railroad property in exchange for use of the road described above and the conveyance of 3.3 acres of land located along the Missouri-Pacific Railroad property to the City; and, WHEREAS, it will be necessary for the restriction of parkland use only to be re- moved from said 2-acre tract of land; and, WHEREAS, the City Council of the City of San Marcos has heretofore ordered that a City Officer Election will be held on April 1, 1978; and, WHEREAS, said Council now wishes to submit the proposition of removal of the parkland use only restriction from the above-described 2-acre tract of land on the April 1, 1978 election ballot; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Part 1. That the following proposition shall be submitted to the voters of the City of San Marcos at an Election to be held April 1, 1978: I FOR/AGAINST - REMOVING THE RESTRICTION FOR PARKLAND USE ONLY FROM A 2.05 ACRE TRACT OF LAND LOCATED ALONG A PORTION OF BUGG LANE BETWEEN HOPKINS STREET AND THE MISSOURI- PACIFIC RAILROAD TRACKS SO AS TO MAKE THE 'PROPERTY AVAILABLE FOR SALE, CONVEYANCE OR LEASE TO SOUTHWEST TEXAS UNIVERSITY; SAID LAND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: I Commencing at a point which is the intersection of the southwest street line of Bugg Lane and the southeast line of a 50' right-of-way, nor or formerly owned by Southwest Texas State University, and further described as being 78.10' on a bearing of S 40 2l' 07" W from a stone monument marking the intersection of the north- east street line of Bugg Lane and the ~forementioned southeast line of a 50' right-of-way extended; thence along the southwest street line of Bugg Lane 600.00', on a bearing of S 450 50' 00" E to a point, said point being the southeast corner of the property herein described, thence 149.30' on a bearing of S 440 lO' 00" W to a point, said point being the south- west corner of the property herein described, thence 596.70' on a bearing of N 450 49' 38" W to a point, said point being the northwest corner of the property herein described and being the intersection of the rear property line and the southeast line of the 50' right-of-way previously described; thence 149.30' on a bearing of N 420 54' 00" E along the aforementioned southeast line of the 50' right-of-way to the point of beginning, said point being the northeast corner of the property herein described, and containing 2.05 acres.
