<br />98a <br /> <br />STATE OF TEXAS <br /> <br />MUSEUM LEASE <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />I <br /> <br />That the City of San Marcos, Texas, a municipal corporation <br />under the laws of the State of Texas, acting by and through the <br />authority conferred on its Mayor, Frank T. Arredondo, and herein- <br />after referred to as "City", by Resolution adopted <br />and The Texas Museum of History, Inc., a non-profit corporation <br />pursuant to the Texas Non-Profit Corporation Act, hereinafter re- <br />ferred to as "Museum", enter into this lease of property for the <br />mutual benefit of the parties and pursuant to the following terms <br />and provisions: <br /> <br />I. <br /> <br />The sUbject property of this lease is the ground floor or <br />first floor of that structure owned by City in the 200 Block of <br />North Guadalupe Street in said City and previously utilized as <br />the City Hall and commonly known in the community as the "Old <br />City Hall." <br /> <br />II. <br /> <br />The term of this lease is for a period of three years from <br />date of execution. Museum shall have an option to renew said <br />lease for an additional three year period commencing on the day <br />after the last day of the first three year term. <br /> <br />II 1. <br /> <br />I <br /> <br />Consideration for this lease agreement is City providing a <br />site for Museum to display historical artifacts and Museum making <br />said artifacts available and displaying the same for the public <br />enjoyment and education of the citizens of San Marcos, Texas. <br /> <br />IV. <br /> <br />It is expressly agreed that City shall incur no cost for <br />the adaptation of the premises for museum purposes nor for the <br />cost of maintenancing the premises during the term of this <br />lease nor for the cost of utilities in operating the museum or <br />making the museum available to the public. Museum does hereby <br />agree not to structurally alter the premises without first ob- <br />taining the approval of the City Council. <br /> <br />V. <br /> <br />It is expressly agreed that all historical artifacts dis- <br />played on the premises shall remain the property of Museum and <br />City shall exert no claim against such artifacts nor be respon- <br />sible for damage to or loss of artifacts kept on the premises. <br />City agrees to maintain the present level of insurance coverage <br />on the structure, but expressly states that no insurance coverage <br />shall be held for the contents of the structure. <br /> <br />I <br /> <br />VI. <br /> <br />Museum agrees to provide evidence of liability insurance <br />coverage protecting Museum and naming City as an additional in- <br />sured by filing with the City Secretary a copy of said policy <br />insuring the acts and conduct of Museum while on the leased pre- <br />mises. Minimum coverage shall be $100,000.00 per person and <br />$300,000.00 for any single occurrence for bodily injury or death <br />
