96. <br /> <br /> INTERLOCAL AGREEMENT <br />CITY OF SAN MARCOS AND TEXAS STATE UNIVERSITY - SAN MARCOS <br />PROPANE MOTOR FUEL FACILITY <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br /> The City of San Marcos ("City") and Texas State University - San Marcos ("Texas <br />State"), enter into t his Interlocal Agreement under t he authority o f t he Interlocal Cooperation <br />Act, Chapter 791 of the Texas Government Code, as amended. <br /> <br />Section 1. Purpose of Agreement <br /> <br /> The purpose of this Agreement is to facilitate the provision of propane as an alternative <br />motor fuel for use by Texas State, the City, and the public. Texas State and the City agree that <br />this agreement serves a public purpose in that it permits Texas State and the City to fulfill their <br />mission of providing service to the San Marcos community, and it promotes the reduction of air <br />pollution by making a clean fuel available to Texas State, the City and the public.- <br /> <br />Section 2. Scope of Services <br /> <br /> a) Texas State agrees to allow the City to install the electrical service necessary for <br />the location of a propane motor fuel dispensing facility (the "Fuel Facility") and for such other <br />uses normally incidental thereto. The site for the Fuel Facility (the "Site") is a concrete slab <br />located on Texas State's property near the metal storage building in the fenced area at the <br />intersection of the northeast comer of Bobcat Stadium parking lot and Aquarena Springs drive as <br />shown on the map attached to this Agreement as Attachment A. The City agrees to install the <br />electrical service, through a contractor, at the Site. Upon completion and acceptance of the <br />electrical service, Texas State agrees to assume responsibility for the service. <br /> <br /> b) Texas State agrees to make the Site available for the installation and maintenance <br />of the Fuel Facility. Texas State agrees to allow access from public roads to the Site to the City <br />for the fueling of City vehicles and to the general Public for fu,~l~n~, of private and government <br />vehicles. <br /> <br />Section 3. Term <br /> <br /> The term of this Agreement will commence on April 12, 2004 and will continue until <br />terminated by either party in accordance with Section 4(f). <br /> <br />SectiOn 4. Miscellaneous Provisions <br /> <br /> a) Interlocal Cooperation: The City and Texas State agree to cooperate with each <br />other in good faith at all times during the term of this Agreement in order to achieve the purpose <br />of this Agreement. Each party to this Agreement acknowledges and represents that this <br />Agreement has been executed by its duly authorized representative. <br /> <br /> <br />
