<br />1. <br /> <br />RESOLUTION NO. 1978-38-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AUTHORIZING <br />ACCEPTANCE OF THE COMPLETION OF WATER <br />AND WASTEWATER ADJUSTMENTS TO FRANKLIN, <br />HAZELTON, MOORE, HARVEY AND L.B.J. DRIVE <br />IN SAN MARCOS, TEXAS; AUTHORIZING FINAL <br />PAYMENT FOR THIS CONSTRUCTION, AND ESTA- <br />BLISHING AN EFFECTIVE DATE. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas, has contracted with Du-Mor <br />Enterprises, for the construction of water and wastewater adjust- <br />ments to Franklin, Hazelton, Moore, Harvey and L.B.J. Drive, San <br />Marcos, Hays County, Texas; and, <br /> <br />WHEREAS, the construction of water and wastewater adjustments to <br />Franklin, Hazelton, Moore, Harvey and L.B.J. Drive was completed <br />on March 28, 1978; and, <br /> <br />l'"" <br />c: <br />- <br />u <br />o:l <br />UJ <br /> <br />WHEREAS, the Director of Public Works and the Community Development <br />Department and the Community Development Inspector inspected these <br />water and wastewater adjustments on March 28, 1978 and determined <br />that the contractual provisions for construction of said water and <br />wastewater adjustments had been met by Du-Mor Enterprises on that <br />date; and, <br /> <br />WHEREAS, the Director of Public Works of the City of San Marcos re- <br />commends that the City Council accept the water and wastewater ad- <br />justments for use by the City effective on the 28th day of March, <br />and authorize final payment to Du-Mor Enterprises in the amount of <br />seven thousand, one hundred seventy-nine dollars and seventy-three <br />cent~ ($7,179.73); and, <br /> <br />I <br /> <br />WHEREAS, Du-Mor Enterprises requests final payment for the comple- <br />tion of the water and wastewater adjustments; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the work performed by Du-Mor Enterprises in con- <br />structing water and wastewater adjustments, be, and is hereby, ac~ <br />cepted as being complete effective on the 28th day of March, A.D., <br />1978, pursuant to the terms of the contract for said construction. <br /> <br />Section 2. That the City of San Marcos is hereby authorized to make <br />the final payment to Du-Mor Enterprises for said construction in the <br />amount of seven thousand, one hundred seventy-nine dollars and <br />seventy-three cents ($7,179.73). <br /> <br />Section 3.
