ORDINANCE NO. 2004- !6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN M -A!~:COS, TEXAS AMENDING CITY CODE SECTION <br />42.103 TO DESIGNATE THE CHARLES S. COCK HOUSE, THE <br />MERRIMAN CABIN, THE OLD FISH HATCHERY BUILDING <br />AND THE DUNBAR SCHOOL BUILDING AS HISTORIC <br />LANDMARKS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />RECITALS: <br /> <br />98. <br /> <br /> O <br /> <br /> d <br /> <br />°1 <br /> <br /> 1. The City Historic Preservation Commission has selected the Charles S. Cock House, the <br />Merriman Cabin, the Old Fish Hatchery Building and the Dunbar School Building as the most <br />significant of the City-owned historic buildings. The Historic Preservation Commission has <br />determined that these buildings meet the criteria of historical, architectural and cultural significance; <br />suitability for preservation or restoration; and educational value necessary to qualify for historic <br />landmark status. The Historic Preservation Commission further found that the properties meet the <br />criteria established for inclusion in the National Register of Historic Places. On December 10, 2003 <br />the Historic Preservation Commission voted to recommend Local Historic Landmark designation for <br />these buildings. <br /> <br /> 2. The City Planning and Zoning Commission has reviewed the Historic Preservation <br />Commission's recommendation in accordance with the provisions of Chapter 42, Article 3 of the City <br />Code, and voted to support the recommendation on February 10, 2004. <br /> <br /> 3. The City Council has conducted a public hearing regarding the recommendations of the <br />Historic Preservation Commission and the Planning and Zoning Commission, and the City Council <br />wishes to designate and establish the Charles S. Cock House, the Merriman Cabin, the Old Fish <br />Hatchery Building and the Dunbar School Building as historic landmarks in accordance with the <br />provisions of Chapter 42, Article 3 of the City Code. <br /> <br />BE IT ORDAINED. BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION 1. Section 42.102 of the City Code is amended as follows (underlining indicates <br />added text and over-str-i~ indicates deleted wording): <br /> <br />Sec. 42.103. Designation of local historic landmarks. <br /> <br /> (a) There is establ:.shed tT_he following local historical landmarks are hereby designated within <br />the corporate limits: <br /> <br />(1) The Oak Heights Live Oak Tree located in the 500 Block of Franklin Drive. <br /> <br />(2) The Charles C.
