When capability to respond has <br />been restored, said rotation file card shall be placed at the rear <br />of the file in the last position of rotation notification order. <br /> <br />Section 6. Equipment. Each wrecker to be utilized under the <br />prov1s1ons of this ordinance shall consist of a minimum of one <br />ton capacity and shall be equipped with appropriate emergency <br />lights, fifteen pound carbon dioxide fire extinguisher, a push <br />broom measuring 24 inches in width and a pry bar measuring 6 feet <br />in length. Any such wrecker shall be subject to inspection at <br />any time by any officer of the Department of Public Safety. <br /> <br />Section 7. Records. Records of services provided under this <br />ordinance shall be maintained by each Commerci~l Towing or <br />Wrecker Service for a minimum period of one year and shall be <br />made available for inspection upon request by the Director of <br />Public Safety or his representative. Department of Public <br />Safety communication personnel shall maintain an activity log <br />of calls made and the Rotation System. Any officer impounding <br />a vehicle that is not involved in an accident shall submit <br />a report form as to the physical appearance of the vehicle, <br />of which one copy shall be supplied to the wrecker operator. <br /> <br />I <br /> <br />Section 8. Fees. Each participating Commercial Towing and <br />Wrecker Service shall be limited in the fees it charges for <br />tows authorized by the Department of Public Safety. Such fees <br />shall be no more than: <br /> <br />1. $25.00 - any tow within the City limits. <br />2. $25.00 + $1.00 per mile - any tow authorized <br />outside the City limits. <br />3. $37.50 - any tow where dollies are required. <br />4. $25.00 per hour - for labor if additional <br />labor is required other than a normal tow. <br />5. $3.00 per day - storage fees. <br /> <br />Payment of said fees shall be the obligation of the vehicle <br />owner or operator. The City of San Marcos shall not be <br />liable for the payment of said fees. <br /> <br />I <br /> <br />Section 9. Liability. Any Commercial Towing or Wrecker Service <br />performing services under the provisions of this ordinance shall <br />assume the liabilities associated with said services and shall <br />hold the City of San Marcos harmless from all claims, actions and <br />lawsuits which may result from injury to persons and/or damages <br />to property caused by said Commercial Towing or Wrecker Service, <br />its agents or employees. Each Commercial Towing or Wrecker <br />Service must maintain in force liability insurance in the minimum <br />amounts of $100,000.00 per person and $300,000.00 for any single <br />occurrence for bodily injury or death and $10,000.00 for any <br />occurrence for injury to or destruction of property; a copy of <br />which insurance policy must be filed with the City Secretary. <br />Any vehicle or articles inside said vehicle shall be the sole <br />responsibility of the Commercial Towing or Wrecker Service towing <br />the vehicle. <br /> <br />Part 2.
