property in which a lawful owner has been determined, or property to which a <br />claim of right to possession has been asserted. <br /> <br /> Impounded property means any abandoned personal property impounded <br />by a police officer. <br /> <br /> Motor vehicle includes any motor vehicle subject to registration under the <br />state Certificate of Title Act, and any motorboat or outboard motor. <br /> <br />SECTION 2. Section 34.163 of the City Code is added as follows: <br /> <br />Sec. 34.163 Disposition of Found Property <br /> <br /> (a) Found property shall be held by the police department for no less <br />than 90 days after the property is turned in to the department. <br /> <br /> (b) During the 90 day period, the police department shall make a <br />diligent effort to identify and contact the owner of the found property, <br />documenting each effort. The chief of police shall promulgate the procedures to <br />be used, including appropriate methods of notice. <br /> <br /> (c) If the police department is not able to identify or contact the owner <br />of found property within the 90 day period, the police department will attempt to <br />notify the finder of the property, and shall release the found property to the finder <br />if all of the following are met: <br /> <br />(1) The finder has filed a written notice with the department of the finder's <br /> desire to claim the found property; <br />(2) The finder physically takes possession of the found property within 30 <br /> days of the notice from the police department; and <br />(3) The finder is not a city employee. <br /> <br /> (d) Found property that has not been claimed by the owner under <br />subsection (b), and not Claimed by the finder under subsection (c), shall be <br />destroyed, auctioned, disposed of, or converted for City use at the expiration of <br />the respective holding period. <br /> <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this ordinance will continue in full force if they can be given effect <br />without the invalid portion. <br /> <br /> SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br /> <br />
