1 I 1- 156 RESOLUTION 1978-45-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING ACCEPTANCE OF THE COMPLE- TION OF THE DRAINAGE CONFLUENCE PROGRAM CONSTRUCTED UNDER THE COMMUNITY DEVELOPMENT PROGRAM; AUTHORIZING FINA~ PAYMENT FOR THIS CONSTRUCTION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, has contracted with Du-Mor Enterprises for the construction of public facility improvements in a project titled Drainage Confluence Phase II, Project Number B76-HS-48-0505, in the City of San Marcos, Hays County, Texas; and WHEREAS, the City has been notified by consulting engineers of URS/Forrest and Cotton, Inc. and James E. Byrn that a final inspection was held on April 21, 1978, and the project was found to be substantially complete and acceptable; and WHEREAS, consulting engineers recommend the City Council accept the drainage confluence project for use by the City effective April 21, 1978 and authorizing final payment to Du-Mor Enterprises in the amount of $51,599.89; and WHEREAS, Du-Mor Enterprises have requested final payment for the completion of the drainage confluence project; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1. That the work performed by Du-Mor Enterprises in constructing public facility improvements in a project named as Drainage Confluence Phase II, be, and is hereby, accepted as being complete effective on the 21st day of April pursuant to the terms of the contract for said construction. Section 2. That the City of San Marcos is hereby authorized to make the final payment to Du-Mor Enterprises for said construction in the amount of $51,599.89. Section 3.
