<br />I <br /> <br />I <br /> <br />I <br /> <br />! ..I <br /> <br />157 <br /> <br />RESOLUTION 1978-46-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGRE~MENT WITH THE STATE <br />DEPARTMENT OF HIGHWAYS AND PUBLIC <br />TRANSPORTATION GRANTING PERMISSION <br />FOR THE STATE OR ITS AGENT TO PERFORM <br />WORK AS MAY BE NECESSARY TO PROVIDE A <br />MINIMUM PASSIVE WARNING SYSTEM AT <br />THOSE PUBLIC STREETS/ROAD GRADE <br />CROSSINGS OF RAILROADS AS DESIGNED IN <br />THE ATTACHED AGREEMENT. <br /> <br />WHEREAS, in compliance with Section 203 of the Highway Safety <br />Act of 1973, a State-wide program has been developed to <br />inventory and improve passive protection at public railroad <br />grade crossings within the State; and <br /> <br />WHEREAS, Federal funding for such improvements is to be <br />provided by Section 203 of 1976, Highway Safety Act with <br />State matching funds; and <br /> <br />WHEREAS, no City or County funds will be required; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />Part 1. The attached agreement between the City of San Marcos <br />and the State Department of Highways and Public Transportation <br />granting permission for the State, or"its agent, to perform <br />the work described in said contract as may be necessary to <br />provide a minimum passive warning system at those public <br />streets/road grade crossings of railroads within the City of <br />San Marcos, Texas, as designated by the State. <br /> <br />Part 2. That the Mayor, Mr. Robert L. Cavazos, or his <br />successor, be, and 'is hereby, authorized to execute said <br />contract on behalf of the City. <br /> <br />Part 3.
