<br />I <br /> <br />I <br /> <br />I <br /> <br />ORDINANCE 1978-31 <br /> <br />181 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING THAT <br />ORDINANCE WHICH ESTABLISHED NEW 1978 RATES <br />FOR ELECTRICAL UTILITIES IN THE CITY OF <br />SAN MARCOS, SAID ORDINANCE BEING FILED IN <br />VOL. 48 AT PAGE 151 OF THE MINUTES OF THE <br />CITY COUNCIL, BY ESTABLISHING A NEW EFFECTIVE <br />DATE, AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br />Texas, acting within its legal authority, established new <br />electric utility rates for the City of San Marcos by means <br />of an Ordinance read on three (3) separate occasions, to- <br />wit: April 17, 1978; April 24, 1978; and May 8, 1978; and <br /> <br />WHEREAS, the City Charter requires that an ordinance <br />cannot become effective until after a minimum of ten (10) <br />days from and after the final reading by the Council;' and <br /> <br />WHEREAS, the final effective date of said ordinance is <br />an'essential factor in the Public Utility Commission's con- <br />sideration of an interim rate amount to be established pend- <br />ing the appeal of said ordinance to the Public Utility <br />Commission by the Lower Colorado River Authority; and <br /> <br />WHEREAS, the City Council believes that it is in the <br />be~t interest of the citizens of San Marcos to provide for a <br />thirty-one (31) day waiting period for sa~d ordinance to be- <br />come effective, which is greater than the ten (10) day <br />minimum period required by the City Charter; and <br /> <br />WHEREAS, the City Council desires to act in good fai 1:h <br />with the Lower Colorado River Authority and the Public Utility <br />Commi'ssion in establishing reasonable and well founded local <br />electric utility rates, without jeopardizing or abando~ing <br />the fundamental legal rights in rate setting matters possessed <br />by the City of San Marcos as a municipal corporation. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, THAT: <br /> <br />Part One. The 1978 electric utility rate ordinance passed <br />and approved on final reading May 8, 1978, as recorded in <br />Vol. 48, Page 151, of the minutes of the City Council, be <br />and is hereby amended to provide for a waiting period of <br />thirty-one (31) days from and after its final passage, said <br />waiting period prior to the final effective date of said <br />ordinance being greater than the minimum ten (10) days <br />required by the City Charter. <br /> <br />Part Two. That due to the importance of this ordinance in <br />the appeal of Lower Colorado River Authority before the <br />Public Utility Commission of Texas, an emergency and impera- <br />tive public purpose necessary that the provision of the <br />City Charter requiring that ordinance shall be read on three <br />(3) several days and that no ordinance shall become effective <br />until the expiration of ten (10) days following the date of <br />its final passage is hereby dispensed with, this ordinance <br />therefore to be in effect immediately upon its passage by <br />this body. <br /> <br />APPROVED AND ADOPTED this the 19th day of June, 1978. <br /> <br />~~bJ <br /> <br />Mayor <br /> <br />ATTEST:: '.
