I ~ t ~ I -J I -' 1'1 JvJ.4Lc~-1U 7 4 RESOLUTION 1978-S5-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ~~RCOS, ~EXAS, EXPRESS- ING THE INTENT OF SAID COUNCIL TO AUTHORIZE THE EXTENSION OF' WATER AND WASTEWATER UTILITY SERVICE '1'0 AN INDUSTRIAL TRACT ON THE NORTHEAST SIDE OF THE CITY, CONTINGENT ON CERTAIN SPECIFIED CONDITIONS. WHEREAS, the City Council of the City of San Marcos, Texas, is committed to the development of industry in San Marcos; and WHEREAS, the City Council supports the efforts of the San Marcos Industrial Foundation in attracting industrial development in this area; and WHEREAS, the Council has been informed that floodplain problems can be alleviated on the San Marcos Industrial Foundation property located northeast of the City; and WHEREAS, the Council has been further informed that an industrial corporation has expressed an interest in locating a business on said San Marcos Industrial Foundation property if utilities can be made available; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the City Council hereby expresses its intent to allocate a maximum of $lOO.OOO for the extension of an 8" wat~r and wastewater utility service to that certain 165 acre tract of land located northeast of the City of San Marcos and owned by the San Marcos Industrial Foundation. PART 2. That this action contemplated by Council is contingent on the following conditions: a. Receipt of a firm committment from the prospective industry that it will locate a business employing a reasonable amount on the San Marcos Foundation tract described in Part I above; b. Proof from San Marcos Industrial Foundation of receipt of the appropriate clearances from County, State and Federal agencies for the construction of a dike to remove the subject property from the Blanco River floodplain. PART 3. That this funding committment by the City of San Marcos, expire at the end of the 1978-l979 fiscal year and be void unless an extending resolution be duly passed by the City Coun~i' PART 4. That the City Council hereby expresses its intent to annex l65 acre tract into the corporate limits of the City of San Marcos wi thin seven years from the date water and wastewat'_r service has been made available to said tract. PART 5. That this resolution shall become effective immediatel" upon its passage by this Council.
