<br />m. The Grantee/Borrower hereby agrees to comply with the require- <br />ments of and all pertinent rules and regulations issued under and <br />pursuant to the National Environmental Policy Act of 1969 (P. L. <br />90-190); the National Historic Pre~ervation Act of 1966 (SO Stat <br />91S, 16 USC 470); and Executive Order No. llS93 of May 31, 1971). <br /> <br />n. The Project will not cause or be a hazard as a result of flood <br />as required'by Executive Order 11296. The Grantee/Borrower will <br />fulfill any flood insurance requirements under the Flood Disaster <br />Protection Act of 1973 (P.L. 93-234, 87 Stat.97S), as amended, <br />and any regulations issued thereunder by the U.S. Department of <br />Housing and Urban Development and/or the Economic Development <br />Administration. <br /> <br />o. Prior to the disbursement by the Government of any loan funds <br />pursuant to this agreement, the Grantee/Borrower must demonstrate <br />to the satisfaction of the Government that funds are not otherwise <br />available on terms which will permit the completion of the Project <br />as required by Section 201, P.L. 89-136. <br /> <br />I <br /> <br />~ <br /> <br />p. The Grantee/Borrower warrants that the Project will be properly <br />and efficiently administered, operated and maintained as required by <br />Section 604, P.L. 89-136. Prior to construction completion, the <br />Grantee/Borrower shall submit evidence satisfactory to the Government <br />that sufficient funds are available for requisite capital expendi- <br />tures necessary to commence operations and to administer, operate <br />and maintain the Project for its useful life. <br /> <br />2. If compliance with any of the provisions of this Agreement would require <br />the Grantee/Borrower to violate any applicable Federal, State or Territorial <br />law, the Grantee/Borrower shall, as soon as possible, notify the Government, <br />in writing so that appropriate action may be taken by the Government to <br />allow, if possible, the Grantee/Borrower to proceed as soon as possible <br />with construction of the Project. <br /> <br />3. The employment of all laborers and mechanics, including apprentices and <br />trainees, as defined in Parts 3, S and Sa, Subtitle A, Title 29, Code of <br />Federal Regulations, as amended, shall be applicable to every invitation <br />for bids, and to every negotiation, request for proposals, or request for <br />quotations, for construction contract and to every such contract entered <br />into on the basis of such invitation or negotiation. Part Sa. 3, Sub- <br />title A, Title 29, Code of Federal Regulations shall constitute the condi- <br />tions of each contract in excess of $10,000, and each Grantee/Borrower and <br />contractor shall include these conditions or provide for their inclusion, <br />in each such contract. Parts Sa. 4, Sa. S, Sa. 6, and Sa. 7 shall also be <br />included in each such contract for the information of the contractor. <br />Apprentices and trainees shall be hired in accordance with the requirements <br />of Part Sa. <br /> <br />I <br /> <br />- 8 - <br />
