I C. General Requirements 1. Prior to any solicitation of bids for construction work or whenever and so often as the Government requests, a. The Grantee/Borrower shall, in addition to any other steps required by the Agreement, obtain approval by the Government of (a) its final plans and specifications and (b) the bidding procedures for all construction work and for all material and equipment acquisitions. b. The Grantee/Borrower shall furnish evidence satisfactory to the Government that: I (1) the Project costs are reasonable; (2) it has sufficient funds in addition to the funds provided by the Government to complete the Project, including interim financing; (3) it has obtained, or can obtain, all land, rights-of-way, permits, franchises and all Federal, State and local coordinations and approvals necessary to the completion of the Project, and in all other respects has complied with pertinent Federal, State or local laws and (4) its agreement with an architect/engineer for design and other services specifies a fixed or maximum fee for Basic Services. Basic Services are described in the booklet, Requirements for Approved Projects, issued to all Grantee/Borrowers. 2. The Grantee/Borrower shall perform all construction work and make all material, equipment, and any other property acquisitions by contracts or documents which have the prior approval of the Government, except as otherwise specifically authorized by the Government. 3. The Grantee/Borrower, unless a State or a local unit of government, shall require each contractor and subcontractor engaged in the performance of work in the Project to furnish (a) a performance bond, as security for the faithful execution and performance of its obligation under the contract, in an amount equal to at least 100 per cent of the total amount of the contract price, (b) a payment bond, to assure the prompt payment for the furnishing of all supplies, material and labor, in an - 13 -
