<br />I <br /> <br />I <br /> <br />I <br /> <br />~Il <br /> <br />10 I <br /> <br />RESOLUTION 1978-58-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, ~EXAS, EXPRESS- <br />ING THE INTENT OF SAID COUNCIL TO <br />AUTHORIZE THE EXTENSION OF WATER AND <br />WASTEWATER UTILITY SERVICE TO AN <br />INDUSTRIAL TRACT ON THE NORTHEAST SIDE <br />OF THE CITY, CONTINGENT ON CERTAIN <br />SPECIFIED CONDITIONS. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, is <br />committed to the development of industry in San Marcos; and <br /> <br />WHEREAS, the City Council supports the efforts of the San Marcos <br />Industrial Foundation in attracting industrial development in <br />this area; and <br /> <br />WHEREAS, the Council has been informed that floodplain problems <br />can be alleviated on the San Marcos Industrial Foundation <br />property located northeast of the City; and <br /> <br />WHEREAS, the Council has. been further informed that an industrial <br />corporation has expressed an interest in locating a business on <br />said San Marcos Industrial Foundation property if utilities can <br />be made available; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the City Council hereby expresses its intent to <br />allocate a maximum of $100,000 for the extension of an 8" water <br />and wastewater utility service to that certain l65 acre tract <br />of land located northeast of the City of San Marcos and owned <br />by the San Marcos Industrial Foundation. <br /> <br />PART 2. That this action contemplated by Council is contingent <br />on the following conditions: <br /> <br />a. Receipt of a firm committment from the prospective <br />industry that it will locate a business employing <br />a reasonable amount on the San Marcos Foundation <br />tract described in Part 1 above; <br /> <br />b. Proof from San Marcos Industrial Foundation of <br />receipt of the appropriate clearances from County, <br />State and Federal agencies for the construction of <br />a dike to remove the subject property from the <br />Blanco River floodplain. <br /> <br />PART 3. That this funding committment by the City of San Marcos <br />expire at the end of the 1978-1979 fiscal year and be void <br />unless an extending resolution be duly passed by the City Council <br /> <br />PART 4. That the City Council hereby expresses its intent to <br />annex 165 acre tract into the corporate limits of the City of <br />San Marcos within seven years from the date water and wastewater <br />service has been made available to said tract. <br /> <br />PART 5.
