That is not now the case. <br /> <br />Second, if we assume that the intent of our land use manage- <br />ment ordinances is to protect the consumer and save the City the <br />future expense of rectifying past mistakes, then immediate <br />resolution of this problem, one way or the other, is imperative. <br /> <br />Finally, I am concerned that because of the long standing <br />community acceptance of this land transfer practice that unless <br />the City either takes a strong, resolute stand or is successful <br />in enlisting the aid of all persons and government offices in <br />following a more efficient method, then little in the way of <br />effective land management will be accomplished. <br /> <br />After a number of conversations with various people who work <br />in this area, e~g. Austin Planning Department, County Clerk of <br />Hays County, et.a1., I am convinced that the only viable course <br />of action for the City to take is to require the submission of <br />an official plat of property to be developed and to refuse water <br />and wastewater service to those lots or lots which have not been <br />subdivided in accordance with statute. The City of Austin takes <br />this approach. To do otherwise, according to most sources <br />contacted, would present great difficulty in enforcement on the <br />legal front. <br /> <br />Beyond this I can offer little advice. The more I have <br />explored and researched this issue, the more I am convinced <br />that it is up to the City concerned to take a strong, positive <br />position in seeing to it, by whatever means are at its disposal; <br />that property standards are updated and the full intent of the <br />subdivision regulations are maintained. <br /> <br />~ <br /> <br />l~ ~..-...... <br />Ron Carroll <br />City Planner <br /> <br />Attachments <br /> <br />RC/pg <br />
