<br />\.'" ,- <br /> <br />VI. <br /> <br />City agrees that Contractor is to ,furnish only normal and <br />daily maintenance pursuant to this agreement and Contractor is <br />not obligated hereby to provide extraordinary maintenance required <br />by Acts of God. <br /> <br />VII. <br /> <br />I <br /> <br />City agrees to provide all water connections and water <br />necessary for the performance of this contract by Contractor and <br />to provide for all road maintenance at said Cemetery. Contractor <br />agrees that any water connections standing above ground that are <br />destroyed or damaged by the acts of Contractor or his employees <br />shall be replaced by Contractor at Contractor's expense. City <br />also agrees to provide electrical connections and pay an amount <br />equal to the minimum charge for electricity supplied to said <br />Cemetery. Contractor agrees to pay all charges for electricity <br />above the minimum charge. <br /> <br />VIII. <br /> <br />Contractor agrees to provide City a Certificate of Insurance <br />evidencing that Contractor is insured with general public liability <br />insurance. Said policy of insurance shall provide for the follow- <br />ing minimum coverage: <br /> <br />$100,000.00 <br />$300,000.00 <br />$100,000.00 <br /> <br />Personal injury per person <br />Personal injury per occurrence <br />Property Damage <br /> <br />IX. <br /> <br />I <br /> <br />Contractor agrees to indemnify and hold City harmless from <br />all claims and/or legal actions for injuries and/or damages to <br />persons and/or property arising out of services and actions per- <br />formed by Contractor. <br /> <br />X. <br /> <br />Should the terms and conditions of this contract be violated <br />by either party or tne purpose of the making of this contract be <br />lost by either party, this contract may be terminated by giving <br />thirty (30) days written notice to the other party citing the <br />reasons or violations necessitating termination. This contract <br />shall cease and terminate on the lapse of thirty (30) days follow- <br />ing receipt of such written notice. Any money due and payable by <br />City to Contractor shall be paid prior to the lapse of such thirty <br />(30) days and in the event that termination does not c3incide with <br />pay periods established herein, Contractor shall be entitled to a <br />pro data payment on a per diem basis. <br /> <br />Robert L.
