(1) For off-premises si.qns the area shall be the total area measured on <br />all sides of double-faced or triple-faced siqns. <br /> <br />(2) For all other siqns the area shall be measured on only one side of <br />double-faced siqns or triple-faced siqns, provided the faces are oriented <br />with an interior anqle not exceedinq 60 degrees and provided the faces <br />are the same size and share a common structural support. <br /> <br /> SECTION 2. Sections 106.074(d)(1) and (d)(2) of the San Marcos City Code is <br />amended as follows (underlining indicates added text, e~et4:~r~ indicates deleted <br />text): <br /> <br /> (1) Maximum area. 480 square feet per side or, for restructured signs, the <br />area of the existing sign, whichever is less. <br /> <br /> (2) Maximum Height. ~ 25 feet for signs with an area of less <br />than 75 square feet per side, and 42 % feet for signs with an area of 75 square <br />feet to 480 square feet per side. <br /> <br /> SECTION 3. All ordinances and resolution or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br /> SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br /> SECTION $. The importance of this Ordinance creates an emergency and an <br />imperative public necessity, so that the provisions of the City Charter that ordinances be <br />presented at three separate Council meetings, and that no ordinance becomes effective <br />until the expiration of ten days after the date of its final passage, are suspended, and <br />this Ordinance shall take effect and be in full force and effect from and after its adoption <br />and after notice of its adoption is published in a newspaper of general circulation in the <br />City. <br /> <br />PASSED, APPROVED AND ADOPTED on April ]9, 2004. <br /> <br /> Robert Habingreither <br /> Mayor <br /> <br />Attest: <br /> <br />J~nis K.
