<br />I <br /> <br />I <br /> <br />I <br /> <br />47 <br /> <br />ORDINANCE NO. 1978-39 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, FORMALLY <br />ACCEPTING THE DEDICATION TO PUBLIC USE <br />OF A 60-FOOT WIDE STREET RIGHT-OF-WAY <br />COMMONLY KNOWN AS "SPRINGTOWN WAY", <br />WHICH IS LOCATED BETWEEN, AND WHICH <br />CONNECTS THE WEST ACCESS ROAD OF <br />INTERSTATE HIGHWAY 35 AND THORPE LANE; <br />ESTABLISHING AN EFFECTIVE DATE; AND <br />DECLARING AN EMERGENCY. <br /> <br />WHEREAS, one San Marcos North Diversified, Lnc. desires to <br />dedicate a street commonly known as Springtown Way to the <br />City of San Marcos for the use and enjoyment of the public; <br />said street being more fully described in "Exhibit A" which <br />is attached hereto and for all intents and purposes <br />incorporated herein; and, <br /> <br />WHEREAS, the City of San Marcos is willing to accept said <br />dedication and the subsequent responsibility of maintaining <br />said street open for public use; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That upon recordation in the deed records of Hays <br />County, Texas, of an appropriate legal instrument formally <br />dedicating to the City that street commonly known as <br />Springtown Way, more particularly described in "Attachment A", <br />which is attached hereto and for all intents and purposes <br />incorporated herein, the City of San Marcos, shall hereby <br />accept responsibility for the maintenance of said street open <br />to public use and enjoyment. <br /> <br />PART 2. That the desire and intent of the City of San Marcos <br />to accept said dedicated street, be, and is hereby"publicly <br />declared. <br /> <br />pART 3.
