City of San Marcos <br />Fire Department Policies and Procedures <br />20.3.00 Compensatory Time <br />Fire Department operations require some duties be performed outside regularly scheduled <br />shifts. Examples of such duties include, but are not limited to, attending meetings, equipment <br />maintenance projects, participating in public education programs, training and other special <br />assignments. Fire Department personnel work 24 -hours on -duty followed by 48 -hours off -duty. <br />When personnel are required to work hours outside their normal 24 — 48 schedule, they must be <br />compensated for hours worked. <br />20.3.01 Defined: <br />Compensatory time is another type of compensation for overtime work. Compensatory time <br />may be provided employees in lieu of overtime pay. The calculation of hours is the same as if <br />hours were to be paid. <br />20.3.02 Accrual of Compensatory time: <br />Non -shift hours for fire personnel are compensated at time and a half overtime. Compensatory <br />time may be provided in lieu of overtime pay. When earned, hours will be accrued at time and a <br />half. When used hours will be taken as straight time. Any payment for hours due will be paid at <br />straight time. <br />As an example, an employee who works one (1) hour overtime earns one and one -half (1.5) <br />hours of compensatory time. When the compensatory time is used (i.e., the employee takes <br />time off), the time off is paid at the regular rate of pay. The following are some examples of <br />instances where compensatory time may be accrued in lieu of overtime being paid: <br />administrative and project committee meetings, training classes (in and out of town), equipment <br />maintenance, special assignments (i.e. Tax Free and Black Friday weekends), participation in <br />public education and public safety programs (fire prevention week and installation of child safety <br />seats). <br />20.3.03 Use of Compensatory time: <br />Compensatory time must be requested by the employee and approved by the Fire Chief, or his <br />designee, prior to the hours being worked. Employees requesting leave using compensatory <br />time must follow current Fire Department procedures for scheduling and taking leave. <br />20.3.04 Maximum accrual: <br />The maximum number of hours an employee may accrue is 96 (this equates to (4) 24 -hour <br />shifts). Additional hours must be paid. Fire Administration shall maintain records showing <br />compensatory time earned, time used, and the current balance for each employee. Employees <br />are urged to use their accrued compensatory hours at their earliest leave opportunity. <br />20.3.05 Payment at Termination: <br />Upon leaving employment with the City of San Marcos, all existing compensatory time hours, <br />not exceeding the maximum of 96 hours, shall be paid at the regular rate of pay. <br />• <br />
