<br />ORDINANCE NO. 1978-46
<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, ACCEPTING THE
<br />BID OF LARRY N. VILLANUEVA, JR. AND
<br />GUADALUPE D. VILLANUEVA FOR THE PURCHASE
<br />OF LOT 12, BLOCK 12 OF THE C. D. WALLACE
<br />SUBDIVISION OF THE CITY OF SAN MARCOS
<br />AND AUTHORIZING THE MAYOR TO EXECUTE A
<br />WARRANTY DEED TO SAID BIDDER ON BEHALF
<br />OF THE CITY OF SAN MARCOS, IN TRUST,
<br />FOR ITSELF, THE STATE OF TEXAS, THE
<br />COUNTY OF HAYS, AND THE SAN MARCOS
<br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT,
<br />AND DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, the City of San Marcos acquired all that right,
<br />title, and interest, conveyed by Sheriff's Deed, dated
<br />September 5, 1963 in and to Lot 12, Block 12,
<br />of the C. D. Wallace Subdlvlslon of the City of San Marcos,
<br />as trustee for itself, the State of Texas, the County of
<br />Hays, and San Marcos Consolidated Independent School District;
<br />and,
<br />
<br />WHEREAS, the former owners of said lot did not redeem it
<br />within the statutory period allowed; and,
<br />
<br />WHEREAS, the City Council desires to return this property
<br />to private ownership; and,
<br />
<br />WHEREAS, the bid by Larry N. Villanueva, Jr. and
<br />Guadalupe D. Villanueva was the highest and best responsible
<br />bid; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />SECTION 1: That the bid of Larry N. Villanueva, Jr. and
<br />Guadalupe D. Villanueva in the amount of $2,500.00 for Lot 12,
<br />Block 12, of the C. D. Wallace Subdivision of the City of San
<br />Marcos, be accepted as the highest and best responsible bid.
<br />
<br />SECTION 2. That the Mayor of the City of San Marcos,
<br />Robert Cavazos, be, and is hereby authorized to execute a
<br />warranty deed to Larry N. Villanueva, Jr. and Guadalupe D.
<br />Villanueva for Lot 12, Block 12, of the C. D. Wallace Subdivision
<br />of the City of San Marcos, on behalf of the City of San Marcos,
<br />in trust for itself, the State of Texas, the County of Hays,
<br />and the San Marcos Consolidated Independent School District.
<br />
<br />SECTION 3. That the importance of this Ordinance creates
<br />an emergency and an imperative purpose necessary that the
<br />provision of the Charter reading that all ordinances be read
<br />at three separate meetings and that no ordinance shall become
<br />effective until the expiration of ten (10) days following the
<br />date of its final passage, be suspended, and this provision
<br />is hereby suspended, and this ordinance shall take effect and
<br />be in force from and after its adoption, and publication in a
<br />newspaper of general publication within the City.
