<br />EXHIBIT A <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />I <br />I <br /> <br />CONTRACT FOR SERVICES <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a municipal corporation, I <br />existing by and under the laws of the State of Texas, acting <br />by and through its Mayor, Robert L. Cavazos, and the <br />San Marcos Chamber of Commerce enter into this agreement <br />pursuant to the terms and provisions of Chapter 26, Article <br />II of the Code of Ordinances for the City of San Marcos, <br />Texas. <br /> <br />WITNESSETH <br /> <br />That the City of San Marcos has enacting by ordinance a <br />hotel room occupancy tax to be levied upon the occupancy <br />of any room furnished by any hotel within such City. <br />Pursuant to Section 26-21, "Use of Proceeds", the City <br />does hereby agree to allocate funds from the revenue of <br />said tax to the San Marcos Chamber of Commerce. The <br />allocation of funds to said Chamber is hereby agreed to <br />be ninety percent (90%) of the gross of all funds <br />collected from the hotel room occupancy tax. Furthermore, <br />it is expressly agreed that the Chamber shall be entitled <br />to operating an administrative expense not exceeding <br />fifteen percent (15%) of the total allocation of such <br />funds collected from the hotel room occupancy tax to be <br />received by said Chamber. <br /> <br />II <br /> <br />I <br /> <br />The San Marcos Chamber of Commerce does hereby agree to <br />expend said fund for the use of proceeds set out in <br />Section 26-21 of the Ordinance, including advertising <br />for general, promotional, and tourist advertising of the <br />City and its vicinity, and conducting a solicitation and <br />operation program to attract conventions and visitors to <br />the City. The Chamber of Commerce further agrees to <br />submit a semi-annual budget to said City requesting funds <br />available from the revenue of said tax. Such budget <br />presentations shall include a report of activities and <br />expenditures from previously allocated funds. <br /> <br />III <br /> <br />It is hereby agreed that a Tourist Development Committee <br />shall be formed to serve as an advisory committee to said <br />Chamber and no funds allocated from said tax shall be <br />expended without the advise and consent of said committee. <br />The membership of the committee is agreed to be five (5) <br />persons who shall serve for the duration of this agreement. <br />It is specifically agreed between the parties hereto that <br />two (2) members shall be appointed by the City Council of <br />said City, and two (2) members shall be appointed by the <br />Board of Directors of said Chamber. The fifth (5th) member <br />shall be selected by the four (4) appointees. The City <br />Manager of said City and Manager of said Chamber shall be <br />ex-officio members of the Committee. . <br /> <br />I <br />
