<br />I <br /> <br />I <br /> <br />I <br /> <br />127 <br /> <br />RESOLUTION NO. 197B-7B-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, FURTHER <br />EXTENDING THE SUSPENSION OF THE OPERATION <br />OF PROPOSED NATURAL GAS UTILITY RATE <br />SCHEDULES FILED BY ENTEX, INC., FOR AN <br />ADDITIONAL PERIOD OF THIRTY (30) DAYS <br />BEYOND THE ORIGINAL SUSPENSION OF ONE <br />HUNDRED TWENTY (120) DAYS BEYOND <br />AUGUST 18, 1978, THE DATE ON WHICH SAID <br />SCHEDULES WOULD HAVE OTHERWISE GONE INTO <br />EFFECT. <br /> <br />WHEREAS, pursuant to the Texas Public Utility Regulatory <br />Act, exclusive original jurisdiction for the regulation of <br />rates and services provided by gas utilities within the City <br />of San Marcos lies with governing body, to-wit: the San Marcos <br />City Council; and, <br /> <br />WHEREAS, Entex, Inc. did, on July 14, 1978, file with <br />the City Council new schedules of rates for natural gas utility <br />service to become effective within the City of San Marcos on <br />August lB, 1978; and, <br /> <br />WHEREAS, the City Council on July 24, 1978, did suspend <br />the operation of said proposed new schedules for a period of <br />one hundred twenty (120) days beyond August 18, 1978; and, <br /> <br />WHEREAS, the City Council has determined that additional <br />time is needed by the City and its consultants to ensure <br />proper study, investigation, presentation of evidence, and <br />adequate public hearing of such rate change application. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, THAT: <br /> <br />Part 1. Pursuant to Section 43(d) of the Public Utility <br />Regulatory Act, the operation of the Entex, Inc. <br />proposed new rate schedules filed with the City <br />of San Marcos on July 14, 1978, be and is hereby <br />suspended for an additional period of thirty (30) <br />days beyond the original suspensi6n of one hundred <br />twenty (120) days, resulting in a cumulative <br />suspension of one hundred fifty (ISO) days beyond <br />August 18, 1978, the date on which said proposed <br />new rate schedules would have otherwise gone into <br />effect. <br /> <br />Part Z.
