<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, APPROVING AN AGREEMENT BY AND
<br />BETWEEN THE CITY OF SAN MARCOS AND THE STATE OF TEXAS,
<br />ACTING BY AND THROUGH ITS STATE HIGHWAY.AND PUBLIC
<br />TRANSPORTATION COM4ISSION, FOR THE CONS1RUCTION BY
<br />THE STATE OF TEXAS, OF GRADING, STORM SEWERS, ASPHALTIC
<br />CONCRETE PAVEMENT, CONCRETE CURB AND GlfITER, AND INCIDENTAL
<br />ITFMS, ON CERTAIN STREETS WITIUN THE CITY OF SAN MARCOS,
<br />ACCORDING TO TIlE TERMS AND CONDITIONS OF CCM>IISSION MINUTES
<br />NUMBERED 70304, 70839, 70840, and 70923, SAID IMPROVEMENTS
<br />TO BE AT TIlE CITY'S SOLE EXPENSE: AUTIlORIZING TIlE ISSUANCE
<br />OF A CHECK PAYABLE TO TIlE STATE TREASURER, ACCOUNT OF TRUST
<br />FUND NO. 927, IN THE AMOUNT OF $52,500.00 TO PAY TIlE
<br />ESTIMATED COST OF THIS WORK: AND AUTIlORIZING THE MAYOR AND
<br />THE MPMBERS OF THE CITY COUNCIL 1'0 EXECUTE TIlE AGREfMENT
<br />FOR SAID IMPROVEMENTS.
<br />
<br />WHEREAS, the City Council of the City of San Marcos desires to make certain
<br />street improvements, including the construction of grading, storm sewers,
<br />asphaltic concrete pavement, concrete curb and gutter, and incidental items,
<br />on the following streets: Hazelton Street from Girard Street, southwest to
<br />Bishop Street; Franklin Street from Girard Street, southwest to Bishop Street;
<br />Moore Street from Hopkins Street to San Antonio Street; Harvey Street from
<br />Hopkins Street to San Antonio Street; and L.B.J. Drive from Inter-State
<br />Highway 35, North to Colorado Street; and
<br />
<br />WHEREAS, the provisi6nTof these street improvements is solely the City's
<br />responsibility; and
<br />
<br />WHEREAS, the State of Texas, acting by and through its State Highway and
<br />Public Transportation Conunission, will construct or have constructed this
<br />work for and on behalf of the City, at the City's sole expense, excluding
<br />preliminary engineering; now, therefore,
<br />
<br />BE IT REOOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />Part 1. That the agreement, a copy of which is attached hereto and made
<br />a part hereof, by.Ciand between the City of San Marcos and the State of Texas,
<br />acting by and through its State Highway and Public Transporllation Conunission,
<br />for the construction, by the State of Texas, of grading; storm sewers, asphaltic
<br />concrete pavement, concrete curb and gutter, and incidental items, on the following
<br />streets within the City of San Marcos: Hazelton Street from Girard Street,
<br />southwest to Bishop Street; Franklin Street from Girard Street, southwest to
<br />Bishop Street; Moore Street from Hopkins Street to San Antonio Street; Harvey
<br />Street from Hopkins Street to San Antonio Street; and L.B.J. Drive from
<br />Interstate Highway 35, north to Colorado Street, according to the tenns and
<br />conditions of Commission Minutes numbered 70304, 70839, 70840, and 70923,
<br />be and is hereby approved.

<br />Part 2. That the City of San Marcos be and is hereby authorized to issue
<br />a check payable to the State Treasurer, Account of Trust Fund No. 927, in the
<br />amount of $52,500.00 to pay the estimated cost of this work.
<br />
<br />Part 3. That the Mayor and members of the City Council be, and are,
<br />hereby authorized to execute the agreement between the City of San Marcos and
<br />the State of Texas, acting by and through the State Highway and Public Tr~;portation,
<br />Commission, for these improvements.

<br />Part 4. That this Resolution take full force and effect :immediately from
<br />and after its passage.
