<br />RESOLUTION NO. 1977-7-R
<br />
<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS ORDERING AN ELECTION TO BE HELD ON THE 2ND DAY OF
<br />APRIL, 1977 FOR THE PURPOSE OF ELECTING OFFICIALS FOR SAID
<br />CITY AND FOR SUBMITTING PROPOSITIONS FOR AMENDMENTS TO THE
<br />SAN MARCOS CHARTER AND ESTABLISHING PROCEDURE FOR SAID ELECTION.
<br />
<br />WHEREAS, the laws of the State of Texas provide that on April 2,1977, there
<br />shall be elected the following officials for this City:

<br />Councilman, Place 1
<br />Councilman, Place 2
<br />Councilman, Place 3; and
<br />
<br />WHEREAS, the laws of the State of Texas and the Charter of the City of San Marcos
<br />provide for amendments to said Charter to be submitted as ballot propositions in
<br />conjunction with the Regular City Officers' Election; and
<br />
<br />WHEREAS, the laws of the State of Texas further provide that the Election Code of
<br />the State of Texas is applicable to said election, and in order to comply with
<br />said Code, an order should be passed establishing the procedure to be followed in
<br />said election, and designating the voting places and presiding officials for said
<br />election; now, therefore,

<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />PART 1. That all independent candidates at the election to be held on the first
<br />Saturday in April, 1977, for the abovementioned offices file their applications to
<br />become candidates for Place 1, Place 2, or Place 3 with the Mayor of this City at
<br />City Hall, on or before 30 days before the date of said election.
<br />
<br />PART 2. That all of said applications shall be substantially in the following form:
<br />
<br />"To the Mayor of the City of San Marcos, Texas:
<br />
<br />I
<br />
<br />I hereby request that my name be placed upon the official ballot for the
<br />election to be held on the 2nd day of April, 1977, as a candidate for
<br />Place Councilman of said City. I hereby certify that I am above the
<br />age of-rB years, a qualified elector and have resided 12 months next preceding
<br />said election in said City, and I am eligible to hold office under the
<br />Constitution of this State.

<br />PART 3. That all candidates shall file with said application the loyalty affidavit
<br />required by Article 6.02 of the Election Code.

<br />PART 4. That the Secretary of this City shall, in accordance with the terms and
<br />provisions of Article 13.32 of the Election Code, post in her office the names of
<br />all candidates who have filed their applications in accordance with the terms and
<br />provi sions of this order, and said names shall be posted at a conspicuous place in
<br />said office for at least 10 days before said Secretary orders the same to be printed
<br />on the ballot for said election.

<br />PART 5. That the following propositions shall be submitted to the resident,
<br />qualified voters of the City for their action thereupon:

<br />FOR: AMENDING SEC. 3.01, 3.02, 3.05, 3.08, 3.10, 3.11, 4.01, 4.02, 4.03,
<br />4.04, 5.03, ~.04, 5.08, 6.03, 6.09, 6.10, 7.04, 8.14, 8.17, 9.03, 10.03,
<br />10.04, 10.06, AND 12.06 TO CHANGE THE WORDS "COUNCILMAN" AND
<br />"COUNCILMEN" TO "COUNCIL MEMBER(S)" AND TO GENERALLY REWORD THE
<br />SECTIONS TO INSURE THAT SEX WOULD NOT BE A FACTOR IN THE CONSIDERATION
<br />OF ANY CANDIDATE FOR A POSITION IN CITY GOVERNMENT.
