<br />53a <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />x <br /> <br />CONTRACT FOR BUS STOP BENCHES <br /> <br />I <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br /> <br />That on this 14th day of June, A.D., 1977, the City of San <br /> <br /> <br />Marcos, Texas, a municipal corporation existing by and under the <br /> <br /> <br />laws of the State of Texas, hereinafter referred to as "city, and <br /> <br /> <br />Julius Sadowsky, Jr., doing business under the firm name "Bus Stop <br /> <br /> <br />Ads", hereinafter referred to as "Ads", hereby enter into this agree- <br /> <br /> <br />ment, the terms, conditions and considerations for which are set out <br /> <br /> <br />as follow: <br /> <br />1. <br /> <br />I <br /> <br />"City" agrees to allow "Ads" to utilize pertinent "City" right- <br /> <br /> <br />of-way for the location of bus stop benches for the 'use and convenience <br /> <br /> <br />of persons utilizing the University Shuttle Bus System. <br /> <br /> <br />II. <br /> <br /> <br />"Ads" agrees to pay the "City" a fixed sum of Ten and nO/lOO <br /> <br /> <br />($10.00) Dollars annually for such right, and in addi tion, "Ads" <br /> <br /> <br />agrees to pay to "City" annually at San Marcos, Texas, a sum equal <br /> <br /> <br />to five per cent (5%) of the gross receipts received by "Ads" from <br /> <br /> <br />advertising appearing on said benches, said annual payment to be <br /> <br /> <br />made on or before fifteen (15) days after the 6th day of December <br /> <br /> <br />of each year during the term of this contract. <br /> <br /> <br />III. <br /> <br /> <br />"Ads" agrees to keep adequate books and records and to furnish <br /> <br /> <br />certified statements of total gross receipts derived from advertising <br /> <br /> <br />on said benches upon reasonable request of "City". <br /> <br /> <br />IV. <br /> <br />I <br /> <br />"Ads" agrees to establish and maintain said bus stop benches <br /> <br /> <br />within the City of San Marcos at all bus stops utilized by the <br /> <br /> <br />University Shuttle Bus System, subject to the consent of the adjacent <br /> <br /> <br />property owner or owners and subject to the approval of the "City" <br /> <br /> <br />for each location. Upon written request of "City" or adjacent pro- <br /> <br /> <br />perty owners, "Ads" agrees to remove or relocate any bench meeting <br /> <br /> <br />disapproval. <br />
