<br />'I <br /> <br />,..... <br /> <br />~I <br /> <br />F <br /> <br />~I <br /> <br />80a <br /> <br />STATE OF TEXAS <br /> <br />x <br />X <br />X <br /> <br />Sublease Contract <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That on this day of , A.D. 1977, the City of <br />San Marcos, a municipal corporation, existing by and under the <br />Laws of the State of Texas hereinafter referred to as "Ci ty" , <br />acting by and through its Mayor, Mr. Frank T. Arredondo, or <br />his duly authorized successor and the San Marcos Golf Association, <br />hereinafter referred to as "Association", entered into this <br />agreement, the terms and consideration for which being more <br />particularly described as follows: ' <br /> <br />1. <br /> <br />"City" agrees to sublease to "Association" that nine hole <br />golf course situated adjacent to the amusement enterprise. <br />known as Aquarena, and ajacent to Aquarena Springs Motor <br />Hotel, said golf course being more fully described in that <br />lease agreement executed on Febr~ary 28, 1977, between the <br />"City" and Aquarena, Incorporated, said agreeme;nt being attached <br />hereto and made a part of this sublease contract. <br /> <br />II . <br /> <br />The term of this sublease contract is for the calendar year <br />1977, commencing January 1, 1977, and terminating December <br />31, 1977. <br /> <br />III. <br /> <br />"Association" agrees to pay the "City" an annual rental of <br />$2,884.97 at the earliest possible time. <br /> <br />IV. <br /> <br />"Association" further agrees to operate said golf course <br />solely as a municipal golf course, making same available to <br />the public, with said "Association" retaining the authority <br />during the term of this lease to make an arrangement with a <br />professional golfer for operation of such concession on said <br />premises. The profits, if any, realized by such professional <br />golfer from the operation of such concession shall be and re- <br />main the sole property of said golfer. <br /> <br />V. <br /> <br />Golf Course operated by "Association" in accordance with -this <br />sublease contract will not be used for any other purpose than <br />a municipal golf course. <br /> <br />VI. <br /> <br />"Association" shall have the right to make improvements, <br />additions and repairs to said golf course and the building <br />thereon used for club rooms and golf shop, but any and all <br />such improvements, additions and repairs shall be deemed <br />permanent fixtures and a part of the realty 'owned by Aquarena, <br />Inc. <br /> <br />VII. <br /> <br />"Association" agrees to plow back into the real property by <br />way of improvements thereto or into personal property by way <br />
