<br />126 <br /> <br />ORDINANCE NO. 1977 - 38 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, ACCEPTING <br />THE BID OF MS. PINKIE LEE DOWELL FOR THE <br />PURCHASE OF PART OF THE WEST ONE-HALF OF <br />LOT M; BLOCK 4 OF THE B.W. BREEDING ADDI- <br />TION TO THE CITY OF SAN MARCOS; AUTHORIZING <br />THE MAYOR TO EXECUTE A SPECIAL WARRANTY <br />DEED TO SAID BIDDER ON BEHALF OF THE CITY <br />OF SAN MARCOS, IN TRUST, FOR ITSELF, THE <br />STATE OF TEXAS, THE COUNTY OF HAYS, AND <br />THE SAN MARCOS CONSOLIDATED INDEPENDENT <br />SCHOOL DISTRICT; AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the City of San Marcos acquired all that right, title, <br />and interest, conveyed by Sheriff's Deed, dated March 24, 1962, in <br />and to a part of the West one-half of Lot M, Block 4 of the B.W. <br />Breeding Addition to the City of San Marcos, said lot being more <br />particularly described on Exhibit "A" attached hereto, as trustee <br />for itself, the State of Texas, the County of Hays, and the San <br />Marcos Consolidated Independent School District; and <br /> <br />WHEREAS, said lot was not redeemed by its former owners wi thin the <br />statutory period; and <br /> <br />WHEREAS, the City Council desires to return this property to private <br />ownership; and <br /> <br />WHEREAS, the bid by Ms. Pinkie Lee Powell was the highest and best <br />responsible bid; now therefore; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />Section 1. That the bid of Ms. Pinkie Lee Dowell in the amount of <br />$1,532.00 for part of the West one-half of Lot M, Block 4 of the <br />B.W. Breeding Addition to the City of San Marcos, Hays County, Texas, <br />be accepted as the highest and best responsible bid. <br /> <br />Section 2, That the Mayor of the City of San Marcos, Frank T. Arredondi <br />be, and is hereby, authorized to execute a warranty deed to Ms. Pinkie <br />Lee Dowell for said property on behalf of the City of San Marcos, <br />.intrust for itself, the State of Texas, the County of Hays, and the <br />San Marcos Consolidated Independent School District. <br /> <br />Section 3. That the importance of this Ordinance creates an <br />emergency and an imperative purpose necessary that the provision of <br />the Charter reading that all ordinances be read at three separate <br />meetings and that no ordinance shall become effective until the <br />expiration of ten (10) days following the date of its final passage, <br />be suspended, and this provision is hereby suspended, and this ordi- <br />nance shall take effect and be in force from and after its adoption, <br />and publication in a newspaper of general publication within the <br />City. <br /> <br />ADOPTED this 12th day of Soptember, 1977. <br /> <br />I <br /> <br /> <br />jj;;: i~ <br /> <br />Doriss Hambrick <br />Ci ty Secretary <br /> <br />APPROVED: <br /> <br />#L.p{cfL~ <br />
