126 ORDINANCE NO. 1977 - 38 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ACCEPTING THE BID OF MS. PINKIE LEE DOWELL FOR THE PURCHASE OF PART OF THE WEST ONE-HALF OF LOT M; BLOCK 4 OF THE B.W. BREEDING ADDI- TION TO THE CITY OF SAN MARCOS; AUTHORIZING THE MAYOR TO EXECUTE A SPECIAL WARRANTY DEED TO SAID BIDDER ON BEHALF OF THE CITY OF SAN MARCOS, IN TRUST, FOR ITSELF, THE STATE OF TEXAS, THE COUNTY OF HAYS, AND THE SAN MARCOS CONSOLIDATED INDEPENDENT SCHOOL DISTRICT; AND DECLARING AN EMERGENCY. WHEREAS, the City of San Marcos acquired all that right, title, and interest, conveyed by Sheriff's Deed, dated March 24, 1962, in and to a part of the West one-half of Lot M, Block 4 of the B.W. Breeding Addition to the City of San Marcos, said lot being more particularly described on Exhibit "A" attached hereto, as trustee for itself, the State of Texas, the County of Hays, and the San Marcos Consolidated Independent School District; and WHEREAS, said lot was not redeemed by its former owners wi thin the statutory period; and WHEREAS, the City Council desires to return this property to private ownership; and WHEREAS, the bid by Ms. Pinkie Lee Powell was the highest and best responsible bid; now therefore; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: I Section 1. That the bid of Ms. Pinkie Lee Dowell in the amount of $1,532.00 for part of the West one-half of Lot M, Block 4 of the B.W. Breeding Addition to the City of San Marcos, Hays County, Texas, be accepted as the highest and best responsible bid. Section 2, That the Mayor of the City of San Marcos, Frank T. Arredondi be, and is hereby, authorized to execute a warranty deed to Ms. Pinkie Lee Dowell for said property on behalf of the City of San Marcos, .intrust for itself, the State of Texas, the County of Hays, and the San Marcos Consolidated Independent School District. Section 3. That the importance of this Ordinance creates an emergency and an imperative purpose necessary that the provision of the Charter reading that all ordinances be read at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage, be suspended, and this provision is hereby suspended, and this ordi- nance shall take effect and be in force from and after its adoption, and publication in a newspaper of general publication within the City.
