<br />14< <br /> <br />ORDINANCE NO. 1977 - 39' <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING THE PRICE AND TERMS <br />OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF <br />PARCEL NO. 17D-S, BEING MORE PARTICU~ARLY IDESCRIBED <br />ON EXHIBIT "A" ATTACHED HERETO, LOCATED WITHIN THE <br />TEX. A-6, NEIGHBORHOOD DEVELOPMENT PROGRAM;AREA, <br />TO ISAAC R. MENDEZ AND WIFE, MARY MENDEZ, AUTHORIZING <br />THE MAYOR TO EXECUTE THE DEED, AND DECLARING AN <br />EMERGENCY. <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos, Texas advertised for bids for the <br />sale of that certain real property known as Parcfll No. l7D-S and <br />described more fully on Exhibit "A" attached hereto, located within <br />the Tex. A-6, Neighborhood Development Program area, in the San Marcos <br />Record, a local newspaper with a general circulation within tne>------ <br />County of Hays, State of Texas; and <br /> <br />WHEREAS, pursuant to said advertisement, a bid was submitted by <br />Isaac R. Mendez and wife, for said Parcel No. 17D-S'; and <br /> <br />WHEREAS, the said bid met the minimum disposition price set upon <br />said property by the Board of Commissioners of the jUrban Renewal <br />Agency of the City of San Mareos, Texas; and <br /> <br />WHEREAS, the said Board accepted the bid as the highest and best <br />responsible bid for said property by a Resolution duly passed on <br />October 5, 1976, after the bid opening of October 51, 1976; and <br /> <br />I <br /> <br />WHEREAS, said Resolution also approved the terms and conditions for <br />the sale of the said property and recommended thecapproval of said <br />purchase price and the approval of therterms and conditions for the <br />sale, as contained in the bid documents, by the City Council of the <br />City of San Marcos, Texas; and <br /> <br />WHEREAS, the aforementioned bid and proposed use set forth in said <br />bid and the sales terms and conditions pertinent thereto conform <br />to the Redevelopment Plan for the Tex. A-6, Neighborhood Development <br />Program, and conformtto the plan for the development of the City as <br />a whole; now, there fore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. That the terms and conditions of the sale by the City of <br />San Marcos, Texas of Parcel No. 17D-5 within the Tex. A-6, Neighborhood I <br />Development Program area, and more fully described on Exhibit "A" <br />attached hereto, to Isaac R. Mendez and wife, Mary Mendez, are hereby <br />approved. <br /> <br />I <br /> <br />Section 2. That the consideration for the sale for said property <br />being $2,300.00 for 7,812 square feet is hereby approved. <br /> <br />Section 3. That the sale by the City of San Marcos is made subject <br />to restrictmons of the Redevelopment Plan for the Tex. A-6, Neighbor- <br />hood Development Program, as approved and amended; said plan is on <br />file and is available for inspection in the Office of the Director <br />of Community Development of the City of San Marcos. <br /> <br />Section 4. That the conditions of the disposition documents, including <br />the Deed and Contract of Sale for Private Redevelopment, are on file <br />and are available for inspection in the Office of the Director of <br />Community Development of the City of San Marcos, <br /> <br />Section 5. The purchaser is hlneby placed on notice that the subj ect <br />property is subject to assessment under the provisions of Article <br />1105b of the Revised Civil Statutes of the State of Texas. <br />
